Judgment :- 1. The petitioner is a B.T. Assistant in Maths in a Government High School. The next avenue of promotion is Head Master of Government High School. The second respondent issued the panel for promotion to the post of Head Masters of Government High Schools, for the year 2011-2012. The crucial date for inclusion in the panel 20112012 is 1.1.2011. The persons, who have satisfied all the eligibility criteria shall be included in the panel. 2. The petitioner was not included in the panel on the ground that she passed the departmental test that is required only on 16.3.2011 after the crucial date. 3. It is admitted that the examination for the said test took place on 30.12.2010 and the result was published on 16.3.2011 and she was successful. Therefore, the pass in the said test shall relate back to 30.12.2010. The only reason for not including the petitioner in the panel is that she passed the test after the crucial date. 4. It is stated that the B.T. Assistant shall pass the two departmental tests and the petitioner had already passed the other test in 2008 itself. Hence, she is eligible for inclusion in the panel for the year 2011-2012 . 5. Accordingly, the writ petition is allowed directing the respondents 1 and 2 to include the name of the petitioner in the panel for promotion to the post of Head Masters for the year 2011-2012 at appropriate place and consider her case for promotion to the post of Head Master in Government High Schools, if she is otherwise eligible, from the date on which her immediate junior was promoted with all attendant service and monetary benefits. Consequently, the connected M.Ps are closed. No costs.
