JUDGMENT Mr. Rakesh Kumar Garg, J.: (Oral) - Vide this petition, a prayer has been made for quashing of the FIR No.04 dated 11.01.2002 under Sections 419/420/406 & 120 IPC registered at Police Station Haibowal, District Ludhiana as well as all subsequent proceedings arising out of the above said FIR, on the basis of compromise dated 23.12.2011 (Annexure P-2). 2. Noticing the aforesaid contention, notice of motion was issued vide order dated 31.01.2012. 3. On instructions from ASI-Shamsher Singh, Police Station Haibowal, District Ludhiana, learned State counsel has stated before this Court that the charges in the instant case were framed against the petitioners on 04.03.2006. Even most of the evidence has been recorded and as many as six witnesses have been examined. 4. It has been further brought to the notice of this Court that counsel for the petitioners has not brought the aforesaid factum of framing of charges against the petitioners in the instant petition before the Court and thus, a material fact has been concealed from the knowledge of this Court. 5. Not only this, petitioners have filed this petition for invoking the inherent jurisdiction of this Court under Section 482 Cr.P.C of this Court, seeking quashing of FIR in non-compoundable case i.e. under Sections 419/420/406 & 120 IPC . 6. The Hon’ble Supreme Court of India in the case of Gulab Das and others vs. State of M.P. 2012 (1) Crl.L.J 667 has authoritatively law laid down that offence which is not compoundable under Section 320 Cr.P.C., cannot be allowed to be compounded even if there is any settlement between the complainant and accused. 7. While invoking jurisdiction of this Court, petitioners have not come with their hands clean and have concealed material fact of framing the charges. No explanation is forthcoming for not mentioning the aforesaid fact. 8. In this view of the matter, this petition is ordered to be dismissed with costs which are assessed @ Rs.5000/-. 9. The aforesaid costs shall be deposited with the Punjab Legal Services Authority, Chandigarh, within two months from today. ------------------
