JUDGMENT Rajiv Sharma, J. Petitioner was posted in Government Senior Secondary School, Deothi-Majgaon on 2.5.2006. He has been transferred from Government Senior Secondary School, Deothi-Majgaon to Government Senior Secondary School, Bakras against vacancy on 26.5.2012. Respondent-State has filed reply. It is clear from the reply that petitioner has remained posted at his home station with effect from 21.7.1997 to 11.7.2002 and thereafter with effect from 2.5.2006 till date. Petitioner has already completed his normal tenure at Government Senior Secondary School, Deothi-Majgaon. Initially, the petitioner was not granted T.T.A. but vide order dated 12.7.2012, he has been granted T.T.A. as well. Petitioner has no right to remain posted at a particular place. Petitioner has already served at home station for more than a decade, i.e. Government Senior Secondary School, Deothi-Majgaon. 2. The transfer is an incident of service. It is for the employer where an employee has to be posted in public interest. The scope of judicial review in these matters is very limited. The Court can intervene only when the transfer has been made in infraction of any statutory rule or the same is actuated with mala fides. In the instant case, there is neither any arbitrariness nor unreasonableness in transferring the petitioner from Government Senior Secondary School, Deothi-Majgaon to Government Senior Secondary School, Bakras. 3. Accordingly, in view of the observations and discussions made hereinabove, there is no merit in the petition and the same is dismissed. Pending application(s), if any, also stands disposed of. No costs.
