JUDGMENT 1. The applicant is apprehending his arrest in connection with Crime No.608/2011 registered at Police Station Kohafiza, Bhopal for the offences punishable under Sections 420, 467, 468 and 471 of IPC. 2. Learned counsel for the applicant submits that the applicant was not the original author of the forged map. Actually he purchased a plot from the District Infrastructure Limited and Mr. Ramakant was the Director to that Company. After payment, it was agreed that sale deed will be done in the name of that person to whom the applicant would sell the plot. Thereafter applicant sold the plot to one Jakir Abdul Hamid. Thereafter it was found that map issued by the Town and Country Planning Department was not correct and it was forged. But actually the applicant obtained the map from Ramakant. Co-accused Rajesh Gulwani was enlarged on bail vide order dated 14.2.2012 in M.Cr.C.No.14867/2011 and the case of the present applicant is similar to him. Under these circumstances, he prays for anticipatory bail on the ground of parity. 3. Learned Public Prosecutor for the State opposes the application. 4. Keeping in view the submissions made by learned counsel for the parties and the facts and circumstances of the case, without expressing any opinion on the merits of the case, I am of the view that the applicant has a good case for grant of bail of anticipatory nature. Consequently, his application under Section 438 of Cr.P.C. is hereby allowed. 5. It is directed that in the event of arrest, present applicant namely Surendra Grover shall be released on bail on his furnishing a personal bond in the sum of Rs.35,000/- (Rupees thirty five thousand) with a solvent surety in the like amount to the satisfaction of the Arresting Authority. 6. The applicant shall make himself available for interrogation by a police officer as and when required. He shall further abide by the other conditions enumerated in sub-Section (2) of Section 438 of Cr.P.C. 7. This order shall remain in force for a period of 60 days and in the meanwhile, if the applicant so desires, may move an application for regular bail before the competent Court.
