ORDER 12.11.2012 - Heard. The petitioner in this writ petition has sought for a direction to the opposite parties to pay the compensation expeditiously within a stipulated time. Learned counsel for the petitioner submits that the homestead land with building has been encroached by the government for the beneficiary, namely, the N.T.P.C. but while assessing the compensation, the Special Land Acquisition Officer, N.T.P.C., Angul has not taken into consideration the valuation of the existing structures. He further submits that the award passed by the Special Land Acquisition Officer, N.T.P.C., Angul is not satisfied with the determination of market value in respect of the building which is acquired in favour of N.T.P.C. It is brought to our notice that the Special Land Acquisition Officer, N.T.P.C., Angul by letter dated 11.9.2008 (Annexure-5) requested the D.G.M. (H.R.), N.T.P.C./TSTPP, Kaniha to re-verify the estimate of the structure of the petitioner but no response has yet been made. Therefore, the letter dated 11.9.2008 (Annexure-5) may be treated as an application under Section 18 of the Land Acquisition Act. In view of the limited grievance of the petitioner, it would be just and proper for this Court to direct the Special Land Acquisition Officer, N.T.P.C., Angul to refer the matter to the jurisdiction of the concerned Civil Court for re-determination of the market value of the property in favour of the petitioner. On such reference, the reference Court shall examine the report of the valuer and re-determine the market value of the property in question within a period of three months from the date of receipt of a certified copy of this order after hearing the beneficiary, N.T.P.C. With the aforesaid observation and direction, writ petition is disposed of. Urgent certified copy of the order be granted on proper application. Petition disposed of.
