JUDGMENT 1. - Heard. 2. Petitioner is an ex-serviceman and was enrolled in the Indian Army on 5th February 1987 and retired from service on 30th April, 2004. After his retirement he decided to pursue his career in law and was enrolled with Bar Council of Rajasthan in the year 2009. Petitioner submitted his application form for the post of R.J.S. Reservation has not been provided to the petitioner in Rajasthan Judicial Services in the category of ex-servicemen. The petitioner submitted application under Right to Information Act to the RPSC and RPSC replied to him that in the Rajasthan Civil Services (Absorption of Ex-Servicemen) Rules 1988 there is no provision for reservation to ex-servicemen. 3. Mr. R.B. Sharma counsel appearing on behalf of petitioner has submitted that the benefit of reservation to ex-servicemen has been given by the legislature for about 32 departments but there is no provision for such benefit to the law graduates who want to pursue their career in judicial service. The non-inclusion of the Rajasthan Judicial Services in the schedule I of the said Rules of 1988 is per se discriminatory arbitrary and illegal hence the writ application has been preferred. Prayer has been made to direct the respondents for providing reservation to the petitioner in Selection process of Rajasthan Judicial Service as an ex-serviceman; the action of the respondents of not giving reservation be declared to be arbitrary unconstitutional and discriminatory and the petitioner be considered for recruitment in the category of ex-servicemen. 4. After hearing learned counsel for the appellant we are of the considered opinion that the Rules of 1988 cannot be termed as illegal for not providing the reservation in Judicial Services. Judicial Services stand apart from other services. There is no room to join judicial service at advanced age at Munsif Level. The petitioner was an ex-serviceman and thereafter he completed the law and was enrolled with the Bar Council of Rajasthan. Considering the requirement of Judicial Service no provision has been made in RJS Rules for ex-serviceman. Even under Rules of 1988 which provide reservation in 32 services to ex-serviceman no such provision has been made for providing reservation to ex-servicemen in judicial services. Judicial service stand apart from other services. The Rules of RJS are in tune with Rules of 1988.We find no arbitrariness in the Rules of 1988 or RJS Rules.Consequently this writ petition is hereby dismissed.
