JUDGMENT Vijender Singh Malik, J. Paramjit, the petitioner has sought regular bail in a case registered by way of FIR No. 141, dated 06.05.2011 at Police Station Kalanaur, District Rohtak for an offence punishable under sections 148, 109, 114, 302, 307, 323, 325 read with section 34 of the Indian Penal Code, 1860. In brief, the prosecution case is that a group of 17 or 18 persons including the petitioner was collecting donations for Gaushala and during the said operation, an altercation took place in which Bali Pehalwan and Sombir fired gun shots at Vishnu, who died at the spot. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. According to him, his name surfaces for the first time in the statement of Naveen an injured who claims that the petitioner gave a lathi blow on his chest. It is found to be a simple injury. He has further submitted that the petitioner is in custody since 18.06.2011 and that similarly placed co-accused of the petitioner namely Satish, Kuldeep, Rajbir, Dharambir and Rajinder have been granted regular bail by this court. Learned State counsel on the other hand, does not dispute the factual submissions made by learned counsel for the petitioner. He has submitted that it is a serious case where Vishnu has died due to the bullets fired by Bali Pehalwan and Sombir and the petitioner is a member of the said group. The question whether the petitioner shared the common object of the unlawful assembly, would have to be decided at the trial. The role assigned to him is of causing simple hurt to Naveen by a lathi. Other co-accused of the petitioner who were assigned similar role, had been granted bail. Hence, the petition is allowed. The petitioner is ordered to be released on bail on his furnishing a personal bond in a sum of `25,000/- with one surety in the like amount to the satisfaction of the trial court.
