ORDER 1. Heard. 2. Prayer in the petition is to direct the respondents to regularize the service of the petitioner from the date, daily wage employees similarly situated have been regularized in work charged establishment in compliance with the circular dated 6/04/1992. 3. Learned counsel for the petitioner submits that the petitioner was appointed as daily rated employee on 1/05/1986 while the junior of the petitioner was regularized on 27/11/98. It is submitted that petition be allowed and the respondent be directed to regularize the petitioner. 4. Learned counsel for the respondents submits that the petitioner was not possessing necessary academic qualification, therefore, petitioner was not regularized. 5. After taking into consideration all the facts and circumstances of the case and keeping in view that the petitioner is in job since 1986 the petition is disposed of with a direction that upon production of a copy of the order passed by this Court by the petitioner before the Competent Authority of the respondents, the Competent Authority shall decide the claim of the petitioner keeping in view circular dated 11th August,1989 according to which it is alleged that the petitioner is having requisite academic qualification. Needful be done within a period of two months and if the petitioner is found entitled, then monetary benefits be extended to him within a stipulated time.
