Nitin Gunwant Shah v. Indian Bank

2012-06-01

ALTAMAS KABIR, S.S.NIJJAR

body2012
ORDER : Atlamas Kabir, J. - Taken on board. While issuing notice on the Special Leave Petition on 11th August, 2011 and on the Interlocutory Application No.2 on 7th September, SLP(C) 22785/10 2010, this Court had directed the parties to maintain status quo with regard to the property in question, for a period of six weeks or until further orders, whichever was earlier. It appears that, thereafter, the said order was not extended, and, in the meantime, the Debts Recovery Tribunal proceeded with the matter and passed certain orders, including an order to hand over the physical possession of the flat in question to the Court Receiver on 11th January, 2011. The up-shot of the matter is that till today, the petitioner remains in possession of the flat in question. 2. From the report of the Deputy Registrar (Mentioning), the Special Leave Petition is fixed for consideration on 30th January, 2012. Let the matter appear on that date and let it not be deleted from the list. Till 6th February, 2012, the parties are once again directed to maintain status quo with regard to the flat in question. 3. The I.A. is disposed of in the above terms.
