JUDGMENT 1. - The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with F.I.R. No. 343/2007, registered at Police Station Kushalgarh, Distt. Banswara for the offences under Sections 450, 395 and 397 I.P.C. 2. Learned counsel for the petitioner submits that in this case, the petitioner has been arrested after three years of the occurrence and the similarly situated co-accused namely Rawa has already been granted bail and the case of the present accused-petitioner is not distinguishable from that of co-accused Rawa, as such, the present petitioner deserves to be granted bail. 3. Per contra, learned Public Prosecutor has opposed the bail application. 4. I have heard learned counsel for the parties, perused the order impugned and given my thoughtful consideration to the arguments advanced at the bar. 5. Keeping in view all the facts and circumstances of the case, particularly the fact that the similarly situated co-accused has already been granted bail, this Court deems it just and proper to allow the bail application. 6. Consequently, this bail application is allowed. It is further ordered that the accused-petitioner namely Ratan@ Ratna in F.I.R. No. 343/2007, registered at Police Station Kushalgarh, district Banswara, shall be released on bail provided he furnishes a personal bond of Rs. 30,000/-and two surety bonds of Rs. 15,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before the Court on all dates of hearing and as and when called upon to do so till the completion of the trial.Bail Application allowed. *******
