JUDGMENT Mr. S.S. Saron, J.: - Learned counsel for the State has filed affidavit of Mr.Joga Singh Sekhon, Superintendent District Jail, Sangrur, mentioning the period of imprisonment undergone by the applicant/appellant no.3-Rajan Singh @ Raj Singh. The same is taken on record. 2. Heard learned counsel for the parties. 3. The applicant/appellant no.3-Rajan Singh @ Raj Singh has been convicted by the learned Additional Sessions Judge, Sangrur for the offence under Section 307 read with Section 34 IPC, besides, Section 27 of the Arms Act. He has been sentenced to undergo R.I. for a period of 5 years, besides, pay a fine of Rs.5,000/- and in default thereof to undergo R.I. for two months for the offence under Section 307 read with Section 34 IPC. He has also been sentenced to undergo R.I. for three years, besides, pay a fine of Rs.5,000/- and in default thereof to undergo R.I. for two months for the offence under Section 27 of the Arms Act. The said sentences of imprisonment have been ordered to run concurrently. 4. In terms of the affidavit of Mr.Joga Singh Sekhon, Superintendent District Jail, Sangrur, the applicant/appellant no.3 has undergone imprisonment of 1 year, 7 months and 25 days as on 11.04.2012 out of the sentence of 5 years that has been imposed. There is no other case against him and he has not misused the concession of parole or bail. The appeal is not likely to mature for hearing in the near future. 5. In the incident that had occurred on 16.05.2007, the applicant/appellant no.3-Rajan Singh @ Raj Singh is said to have fired shots from the gun that he was holding, however, no injury was caused to anyone. Keeping in view the role attributed to applicant/appellant no.3 Rajan Singh @ Raj, the period of imprisonment undergone by him and the fact that the appeal is not likely to mature for hearing in near future, it would be just and expedient to suspend the sentence of his imprisonment during the pendency of the appeal. 6. Accordingly, the criminal miscellaneous application is allowed and the sentence of imprisonment of applicant/appellant no.3-Rajan Singh @ Raj Singh, during the pendency of the appeal shall remain suspended subject to his furnishing personal bond and surety to the satisfaction of the learned Chief Judicial Magistrate, Sangrur. ---------0.B.S.0------------
