Judgment :- 1. At this stage of the hearing of the writ petition, the learned counsel appearing on behalf of the second respondent had placed before this Court, a communication issued by the Registrar of the Tamil Nadu Veterinary and Animal Sciences University, Chennai, dated 31.01.2012. The said communication reads as follows:- With reference to your letter 2nd cited, I am to state that, the petitioner has undergone Ph.D., decree by availing Extra-Ordinary Leave during the year 2002 - 2003 and therefore, the above leave period will be counted for Career Advancement Scheme as per the decision of the Board of Management in its 75th Meeting held on 29.09.2011. In this connection, I further state that, in the past years, the University, on consideration of the representations made by the individuals has issued orders to count the EOL period availed for higher studies towards Career Advancement Scheme. Since the representations already submitted by the petitioner are prior to the decision of the Board of Management dated 29.09.2011, the petitioner may be requested to submit a fresh representation on the later development for consideration of the University. He has further submitted that the petitioner could make a fresh application, in view of the change in policy of the second respondent University, for the leave period to be counted for Career Advancement Scheme. He has further submitted that if the petitioner make such an application, the same would be considered by the second respondent University and appropriate orders would be passed thereon. 2. In view of the said submissions made by the learned counsel appearing on behalf of the second respondent University, it is made clear that it would be open to the petitioner to make an application to the second respondent University, to consider the leave period availed by the petitioner, for Career Advancement Scheme, as per the decision of the Board of Management, dated 29.09.2011. On such application being made the second respondent University shall consider the same and pass appropriate orders thereon, as expeditiously as possible, not later than six weeks from the date of receipt of a copy of this order. This Writ Petition is ordered accordingly.
