Judgment :- 1. This Writ Petition has been filed praying that this Court may be pleased to issue a writ of certiorari to call for and quash the proceedings of the second respondent, dated 10.01.2012, made in Na.Ka.4151/2011/A1. 2. The main contention of the learned counsel appearing for the petitioner is that the impugned proceedings had been issued by the second respondent without giving a copy of the Inspection Report, based on which such proceedings had been issued to the petitioner and without giving an opportunity of personal hearing. 3. The learned counsel appearing on behalf of the respondents had submitted that the petitioner had not asked for a copy of the Inspection Report, till date. However, he has submitted that the copy of the Inspection Report of the Revenue Inspector, dated 05.01.2012, would be furnished to the petitioner and he would be given an opportunity of personal hearing before further orders are passed. 4. In view of the above, the second respondent is directed to furnish a copy of Inspection Report of the Revenue Inspector, dated 05.01.2012, to the petitioner, within seven days from the date of receipt of a copy of this order. On receipt of the Inspection Report, the petitioner shall submit an explanation to the second respondent, within two weeks thereafter, to the notice, dated 10.01.2012, already issued to the petitioner, by the second respondent. After receipt of explanation to be submitted by the petitioner, the second respondent shall pass appropriate orders thereon, on merits and in accordance with law, within a period of four weeks thereafter, after giving an opportunity of personal hearing to the petitioner. The writ petition is ordered accordingly. Miscellaneous Petition is closed. No costs.
