Through the instant petition, the petitioner apprehending arrest in a case to be registered in District Barnala or any other part of the State, has sought pre arrest bail. 3. A notice was issued to the State with a specific direction to furnish the list of criminal cases registered against the petitioner and the cases in which he is required to be arrested. Two affidavits have been filed, one by Harmik Singh, Deputy Superintendent of Police, Sub Division, Barnala and another filed by Amrit Brar, Assistant Inspector General of Police, Crime, Punjab. The relevant portion of the affidavit submitted by the AIG Crime, reads as follows:- “That as per information received from all the Commissioners of Police, Senior Superintendents of Police in Punjab and Assistant Inspector General of Police, GRP, Patiala no fresh case has been registered against the petitioner Baba Tek Singh in Punjab except three cases i.e. FIR No. 112/2011 u/s 420 IPC PS Dhanola, FIR No. 308 dated 24.9.2011 u/s 405/408/409/420/467/468/471/120-B IPC PS City Barnala and FIR No. 315 dated 21.11.2010 u/s 406/467/468/471/120-B IPC PS City Barnala are already stand registered against the petitioner Baba Tek Singh in District Barnala.” 4. In view of the above affidavit, the petitioner is not required at present to be arrested in any other case and is not required in any criminal case.
In view of the above affidavit, the petitioner is not required at present to be arrested in any other case and is not required in any criminal case. Since the petitioner had earlier been arrested in violation of the conditions of issuance of advance notice before his arrest and he had to file Cr.W.P. 2411 of 2011 through one of his well wishers Parvinder Singh to seek his release from illegal custody, it is deemed appropriate to dispose of this petition with a specific direction that in case the petitioner is required to be arrested in any criminal case, registered at PS Dhanola or P.S. City Barnala, he would be given five days notice in advance to be served personally upon the petitioner in order to enable him to avail the legal remedy, available to him as per law. In case he is required to be arrested in any other case in the State of Punjab, he will be given seven days notice in writing by the SHO of the concerned Police Station in order to enable him to avail the legal remedy, available to him. This order will remain operative for a period of next six months and will be available to the petitioner in the circumstances, mentioned in the petition. ---------0.B.S.0------------
