Judgment :- 1. Heard the learned counsel appearing for the petitioner and the learned counsel appearing on behalf of the respondent. 2. At this stage of the hearing of the writ petition, the learned counsel appearing on behalf of the petitioner had submitted that it would suffice, if the application of the petitioner, dated 12.10.2009, is directed to be disposed of by the respondent, on merits and in accordance with law, within the specified period. 3. The learned counsel appearing on behalf of the respondent, has no objection for such an order being passed by this Court. 4. In view of the submissions made by the learned counsels appearing on either side, the respondent is directed to consider the application for the petitioner, dated 12.10.2009, and pass appropriate order thereon, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order, if no order has been passed by the respondent on the said application or in favour of any third party, for the removal of Savudu, in PWD tank, comprised in S.F.No.107/1, Padur Village, Poonamallee Taluk, Tiruvallur District, till date. The petitioner is directed to furnish a copy of the application, dated 12.10.2009, to the respondent, along with a copy of this order. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter. Accordingly, the writ petition is disposed of. No costs. Consequently, connected the Miscellaneous Petition is closed.
