Judgment Rajiv Sharma, J. 1. Petitioner was transferred from Government Primary School, Dayere on 13.4.2012. Now, she has been transferred from Government Primary School, Marhana to Government Primary School, Buhar (Jhandutta) on 26.5.2012. 2. We had directed the respondent-State to give the details of the postings of the petitioner, respondent No.5, Vishal Kumar and Pradeep Kumar. It is evident from the details supplied to the Court by the respondent-State that the petitioner has remained posted within the radius of less than 15 KMs with effect from 21.3.1992 till date. Respondent No.5 has remained posted in Government Primary School, Rachheda, which is at a distance of 60 KMs from his native place. He remained posted in Government Primary School, Dumehar for a period of five years, which is at distance of 58 KMs. Thereafter, he has served within the radius of 25 KMs with effect from 10.9.2007 to 15.6.2012. Sh. Vishal Kumar has been appointed on regular post only with effect from 17.4.2009. Sh Pradeep Kumar has been regularized on 16.2.2009 and before that he was appointed as Vidya Upasak on 16.8.2000. He has also worked within the radius of 25 KMs. However, the fact of the matter is that petitioner has remained posted within the radius of 15 KMs from his native place. 3. Transfer is an incidence of service. The scope of judicial review in these matters is very limited. The Court may intervene only when the transfer has been made in infraction of any statutory rule or the same is actuated with mala fides. The petitioner has been transferred from Government Primary School, Marhana after clubbing the short stay. There is no arbitrariness or unreasonableness in the transfer order dated 26.5.2012 whereby the petitioner has been transferred from Government Primary School, Marhana to Government Primary School, Buhar (Jhandutta). 4. Accordingly, we see no merit in the petition and the same is dismissed. Pending application(s), if any, also stands disposed of. No costs.
