ORDER Heard Sri I. Laxmikanth Rao, learned Counsel for the petitioners. 2. The writ petition is filed for a mandamus to declare the action of the respondent as null and void for not following the seniority list of S.C. & S.T. (daily wage employees under Class IV Cadre) working in Kakatiya University at Warangal, and for a consequential direction to the respondent to appoint the petitioners in regular vacancies which arise in the respondent-University. 3. Though the petitioners claim irregularity by the Kakatiya University in following the seniority list of S.C. & S.T. daily wage employees and seek a consequential direction for employment in the University service, it is seen that Kakatiya University is not impleaded as a party to the writ petition. The sole respondent impleaded is the Registrar, Kakatiya University under Section 3(3) of the A.P. Universities Act, 1991 clearly enacts that a University shall be a body corporate having perpetual succession and a common seal and shall sue and be sued by the said corporate name. 4. As the Kakatiya University, which is a persona juris as per the legislative mandate of Section 3(3) of the A.P. Universities Act, 1991, is not impleaded in this writ petition, the writ petition suffers from a fatal infirmity of a proper and necessary party not having been impleaded. 5. The writ petition is accordingly dismissed. There shall be no order as to costs.
