Judgment Rajiv Sharma, J. 1. Petitioner was posted in Government Primary School, Gawali on 11.6.2008. He made a representation for mutual transfer with respondent No.4, who was posted as J.B.T. Teacher in Government Primary School, Kasala (Drang-II). Thereafter, vide office order dated 16.4.2012, petitioner was transferred from Government Primary School, Gawali to Government Primary School, Kasala and respondent No.4 was transferred from Government Primary School, Kasala to Government Primary School, Gawali. However, order dated 16.4.2012 could not be implemented in view of letter dated 3.5.2012 addressed by Block Elementary Education Officer, Drang-II at Padhar to the Deputy Director of Elementary Education, Mandi. The Block Elementary Education Officer has brought to the notice of the Deputy Director of Elementary Education that the short stay of Desh Raj was less than one year and the same has not been condoned by the competent authority. 2. Mr. Vivek Singh Thakur, learned Additional Advocate General has drawn the attention of the Court to conditions of the transfer/adjustment annexed with the transfer order dated 16.4.2012. According to condition No.10 stipulated in the order dated 16.4.2012, normal stay/distance as per the transfer policy dated 8.12.2010 was required to be condoned by the competent authority. In this case, short stay of Desh Raj has not been condoned. Thus, there is no illegibility in order dated 3.5.2012. Respondent No.4 has remained posted in Government Primary School, Taryambly with effect from 16.4.2002. Thereafter, he was transferred to Government Primary School, Kasala (Drang-II) on 24.5.2011. He has worked at Kasala for a period of less than three years. 3. Accordingly, we see no merit in the petition and the same is dismissed. Pending application(s), if any, also stands disposed of. No costs.
