ORDER : Heard Mr. Aniruddha P. Mayee, learned counsel appearing for the petitioner and Mr. Subromanium Prasad, learned counsel appearing for the CBI. 2. The petitioner is one of the accused in the case relating to the killing of Sohrabuddin in a police encounter that is alleged to be fake. 3. In the charge-sheet submitted by the CBI, there are material and substantive allegations against the petitioner. However, in this application, the petitioner makes a prayer for release on temporary bail on the ground that his mother is suffering from cancer. 4. In course of submissions, counsel for the petitioner stated that though she has been operated upon she is required to undergo further chemotherapy. 5. From the record it also appears that on previous two occasions the petitioner was released on bail for short periods and he never misused the privilege granted to him by the court. 6. In those circumstances, we direct that the petitioner be released on temporary bail for a period of one month from the date of his release on furnishing bail bond of Rs. 50,000/- with two sureties of the like amount each to the satisfaction of the trial court. 7. The petitioner must surrender before the expiry of one month from the date of his release.
