Judgment Rajiv Sharma, Judge. 1. Petitioner was working in Government Senior Secondary School (Boys), Rampur since 3.7.2003. He was transferred to Government Degree College, Rampur in the month of February, 2007. Petitioner has now been transferred from Government Degree College, Rampur to NCC Office Rampur vide office order dated 21.9.2012. Petitioner has remained posted in Government Senior Secondary School (Boys), Rampur since 3.7.2003. Even according to latest transfer order dated 21.9.2012, petitioner has merely been transferred from Government Degree College, Rampur to NCC Office Rampur. Moreover, the transfer order dated 21.9.2012 has been issued with the prior approval of the competent authority. 2. Transfer is an incidence of service. The scope of judicial review in these matters is very limited. The Court may intervene only when the transfer has been made in infraction of any statutory rule or the same is actuated with mala fides. Petitioner has not alleged any specific mala fides. There is no arbitrariness or unreasonableness in the transfer order whereby the petitioner has been transferred from Government Degree College, Rampur to NCC Office, Rampur. 3. Accordingly, we see no merit in the petition and the same is dismissed. Pending application(s), if any, also stands disposed of. No costs.
