1. Two vacancies of ReT teachers (one for math stream and another for science stream) were to be supplied in upgraded Govt. Primary School, Sartajabad Shirpora. Respondent No. 5 as against the science stream and respondent No. 6 as against math stream have been tentatively selected. Petitioner had competed as against science stream, claims to be superior in merit as against respondent No. 5 but has not been selected. 2. In the objections filed by respondents No. 1 to 4 it is clearly submitted that the respondent No. 5 has been selected in view of having additional qualification of M.A in Education. 3. Learned counsel for the petitioner would contend that the respondent No. 5 has done her Post Graduation in Islamic Studies. In this connection has placed en record photocopy of the marks card wherein respondent No. 5 is shown to have done her Post Graduation in Islamic Studies. The higher qualification in the subject other than the relevant subject is not to be taken into consideration. 4. The controversy has been set at rest by the Division Bench of this Court in the judgment rendered in LPA No. 117/2011 captioned Afroza Jan v. Feroz Ahmad Parray & ors decided on 04.08.2011, wherein question for consideration was as to whether MA degree in Urdu is to be given special preference. It has been held "in absence of any other statutory prescription or the prescribed rule or regulation notified by the respondent-State, such claim cannot be countenanced." In view of the said judgment a communication has been issued by Additional Secretary to Govt. Education Department, addressed to Director School Education, Kashmir dated 28.3.2011, wherein it has been provided:- "The candidates having Science/Math educational background are required to be considered for engagement as R-e-T in Upper Primary School, the candidates possessing highest merit in Science/Math subject for which post is tised Used shall have substantial claim and higher qualification in other subjects does not make any claim for the post of R-e-T in Upper Primary Schools". 5. Now position is clear that Post Graduation in subjects other than math and science or education are not to be taken into consideration while selecting candidates for engagement as ReT as against science or math stream. Since the respondent No. 5 has been selected on the basis of possessing additional qualification of MA in Islamic Studies.

Now position is clear that Post Graduation in subjects other than math and science or education are not to be taken into consideration while selecting candidates for engagement as ReT as against science or math stream. Since the respondent No. 5 has been selected on the basis of possessing additional qualification of MA in Islamic Studies. The said additional qualification is not to be taken into consideration so has to be ignored for the purposes of engagement as ReT. The position is now settled, therefore, the tentative select list impugned, vis-a-vis, science stream, requires fresh look. 6. This writ petition is disposed of with the direction to respondent Chief Education Officer to select the candidate as ReT in science stream who will be superior in merit. While doing so, the additional qualification (MA in Islamic Studies as possessed by respondent No. 5) shall be ignored. The selection process be finalized within a period of four weeks from the date copy of the order is served upon respondent Chief Education Officer. 7. Petition accordingly disposed of along with connected CMP.
