1. Seeking a Command to the respondents for his engagement as District Monitor, being the only eligible candidate therefor, the petitioner questions Rajin-der Chopra's selection and engagement as District Monitor (Jammu Division) under National Rural Health Mission on the ground that having not retired from Government Service, Rajinder (Chopra-respondent No. 3 was not eligible for engagement as District Monitor, in that, the post was meant only for retired officials from the State Government. 2. During the course of hearing, it was not disputed by the learned State counsel that respondent No. 3 was not a retiree at the time he applied for selection as District Monitor.
