B.S. Verma, J.— Heard Sri Parikshit Saini, Advocate appearing on behalf of the petitioner. 2. By means of this petition the petitioner has sought a writ in the nature of certiorari for quashing the order dated 8-11 -2012 passed by Civil Judge (S.D.) Haridwar in O.S. No. 251 of 2012, Smt. Laxmi and another vs. Rajveer Singh, contained in Annexure No.6 to the writ petition. 3. According to the petitioner a caveat application was filed on 17-9-2012 and the suit was filed on 8-11 -2012. As per provision of Section 148-A C.P.C. for a period of three months the caveat remains in force from the date of its filing. It appears that the office has not reported the caveat application and the Court without considering this aspect of the matter issued an exparte injunction. 4. The impugned exparte order has been passed on 8.11.2012 without hearing the petitioner (caveator), and date for hearing of application on merit has been fixed 7.12.2012, therefore, the petitioner may file recall application for recalling the exparte order dated 8-11 -2012 on the ground that the caveat application was not reported by the official of the court and the interim order has been passed exparte without hearing the caveator. The petitioner shall also file objection against the application filed U/O 39 Rule 1 and 2 C.P.C. along with recall application and If such an application is filed the same shall be considered by the trial court and decide the same after hearing both the parties, expeditiously as far as possible, preferably, within a period of four weeks, from the date of filing of the recall application. 5. With the above observation the writ petition is disposed of finally. 6. Let a certified copy of this order may be supplied to the learned counsel for the petitioner today itself on payment of requisite fee. Petition disposed of. _____________
