JUDGMENT Mr. Ram Chand Gupta, J.: (Oral) - This is an application for regular bail filed under Section 439 of Cr.P.C. in FIR No.61 dated 13.4.2012 registered under Sections 406, 420 and 120-B of Indian Penal Code, at Police Station Guru Har Sahai, District Ferozepur. 2. I have heard learned counsel for the parties and gone through the record. 3. It has been argued by learned counsel for the petitioner that even as per version in the FIR, contract was with M/s Narula Agro of which Pawan Kumar is sole proprietor and that paddy was also entrusted to Pawan Kumar, sole proprietor of M/s Narula Agro. Further contends that present petitioners are having no concern with M/s Narula Agro or with the paddy entrusted to M/s Narula Agro by Punjab Warehouse Corporation. Further contended that petitioner No.2 is running some other Rice Mill namely M/s Jai Shiv Bhole and that some paddy from Rice Mill of petitioner No.2 has been taken away by the police and however, the said paddy was entrusted to petitioner No.2 by another agency namely PUNSUP and not by Punjab State Warehouse Corporation and further contended that they have been illegally arrested by the police and have been continuing in custody since 15.04.2012. 4. Bail application has been opposed by learned counsel for the State as well as learned counsel for the complainant on the plea that though Pawan Kumar is sole proprietor of M/s Narula Agro to whom paddy was entrusted by Punjab Warehouse Corporation, Ferozepur. However, it came during investigation that Rice Mill was managed by Amit Kumar and his father Raj Kumar and they had misappropriated the paddy. Further contends that present petitioners are related to Amit Kumar and Raj Kumar. 5. In view of these facts, the present petitioners have been implicated in this case merely on the ground that they are related to Amit Kumar and Raj Kumar who are further related to Pawan Kumar, sole proprietor of M/s Narula Agro to whom the paddy was entrusted. 6. Hence, keeping in view these facts and without expressing any opinion on merits, the instant application for regular bail filed on behalf of petitioners Ravi Kumar and Sunil Kumar is allowed. 7.
