Judgment :- 1. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents. 2. The main contention of the learned counsel for the petitioner is that the application made by the petitioner for the grant of lease, for the quarrying of colour granites, in the patta lands belonging to the petitioner, in S.No.55/3, at Allaerahalli Village, Potchampalli Taluk, Krishnagiri District, had not been considered by the respondents in spite of the several representations made by the petitioner. 3. The learned counsel appearing on behalf of the respondents had submitted, on instructions, that an enquiry had been initiated against the petitioner, regarding the illegal quarrying of colour granites in the land in question. A show cause notice had also been issued to the petitioner, which had been received on 1.2.2012. Therefore, the request of the petitioner made in his application, dated 16.6.2011, would be considered only based on the result of the said enquiry. 4. In view of the submissions made by the learned counsel appearing on behalf of the respondents, this Court is of the view that the relief prayed for by the petitioner, in the present writ petition, cannot be granted at this stage. However, it is made clear that the third respondent shall consider the application of the petitioner, dated 16.6.2011, and pass appropriate orders thereon, taking into consideration the result of the enquiry proceedings already initiated against the petitioner. As such, since no further orders are necessary, the writ petition stands closed. No costs. Consequently, connected miscellaneous petition is closed.
