JUDGMENT 1. - Heard learned counsel for the petitioner. 2. Review petition was filed way back on 09.04.2007. It is barred by 58 days. Application under Section 5 of the Limitation Act was not filed along with the review petition and the same has not been filed till date since 09.04.2007. We have two options. First option, is to dismiss the review petition being barred by limitation and second option is to return the review petition, so the petitioner may file fresh review petition along with application under Section 5 of the Limitation Act. 3. We opt, second option, and pass an order to return the review petition to learned counsel for the petitioner. 4. Registry is directed to return review petition to learned counsel for the petitioner.
