JUDGMENT 1. - Heard learned counsel for the parties. 2. Learned counsel for the appellant submitted that he has received instructions from the appellant-corporation to the effect that the appellant-corporation will take Respondent No. 1-workman on duty and the workman will not be entitled to any arrears or difference of amount. He submitted that he has received letter in writing dated 21.12.2011 from appellant-corporation and copy of the letter was made available yesterday to learned counsel for Respondent No. 1-workman. Learned counsel for Respondent No. 1-workman agrees to the above proposal and submits that special appeal may be disposed of in terms of proposal of appellant-corporation for settlement of the case. 4. Letter dated 21.12.2011 is taken on record. 5. The intra Court appeal stands disposed off in terms of compromise, as reproduced above. The award of the Labour Court as well as order passed by the Single Bench both are modified accordingly. 6. Learned counsel for the appellant undertakes that reinstatement order of Respondent No.1-workman will be issued by the appellant-corporation positively within 15 days. 7. Parties are directed to bear their own costs. 8. In view of above, I.A. No. 42367/2011 under Section 17-B of the Industrial Disputes Act, 1947 stands disposed off.Appeal Disposed of. *******
