JUDGMENT Mr. Ram Chand Gupta, J.: (Oral) - CRM No.36773 of 2012 Application is allowed subject to all just exceptions. CRM No.36772 of 2012 Request for placing on record copy of statement of PW1 Gurmej Singh, PW2 Sukhwinder Kaur and PW3 Kulwinder Singh alias Sahib, recorded by learned trial Court. The same are taken on record subject to all just exceptions. Criminal Misc. stands disposed of. CRM No.M-5886 of 2012 This is an application for regular bail filed under Section 439 of Cr.P.C. in FIR No.96 dated 12.08.2011 under Sections 302, 201, 120-B of Indian Penal Code and Section 25 of Arms Act, 1959, registered at Police Station Sadar Khanna, District Khanna. 2. I have heard learned counsel for the parties and gone through the record. 3. It has been argued by learned counsel for the petitioner that petitioner was just 18 years of age at the time of occurrence and that all the material witnesses did not support the prosecution case and turned hostile. She has also placed on record statements of PW1 Gurmej Singh, PW2 Sukhwinder Kaur and PW3 Kulwinder Singh alias Sahib. She further submitted that petitioner has been continuing in custody since 16.08.2011 and that trial is not likely to be concluded in near future as some formal witnesses still remain to be examined. 4. Learned counsel for the State has not disputed these facts, rather, it has been stated that an enquiry was held as per order of Human Rights Commission, Punjab and that in the said enquiry as well, petitioner was found innocent. Hence, bail application not opposed. 5. There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. 6. Hence, keeping in view these facts and without expressing any opinion on merits, the instant application for regular bail filed on behalf of petitioner Lavinder Singh @ Hinda is allowed. 7.
