JUDGMENT 1. - Heard learned counsel for the parties and perused the judgments impugned passed by the Rent Tribunal, Jodhpur as well as Appellate Rent Tribunal, Jodhpur. 2. In the facts and circumstances of the case, I am not inclined to interfere in the concurrent finding of fact arrived at by the Courts below. Hence, this writ petition is dismissed. 3. However, counsel appearing on behalf of the petitioner submits that for vacating the premises in question, time may be granted to the petitioner. Learned counsel appearing on behalf of the respondent submits that he has no objection if time is granted but the time to be granted should be reasonable because decree has been passed in favour of the respondent by the Rent Tribunal, Jodhpur in the application filed in the year 2004 and the same is affirmed by the Appellate Rent Tribunal vide judgment dated 09.12.2011. 4. After considering the prayer made by the petitioner and submission of learned counsel for the respondents, I deem it appropriate to grant time to the petitioner for handing over peaceful possession of the premises in question to the respondent-applicant and it is ordered that the petitioner shall hand over the possession of the premises in question to the respondent-applicants on or before 31.12.2012 and, for that purpose, the petitioner shall furnish undertaking before the Rent Tribunal, Jodhpur within a period of 15 days that he will give vacant possession on or before 31.12.2012 and pay mesne profits month by month till vacating the premises. It is made clear that if the petitioner will fail to hand over vacant possession of the premises in question on or before 31.12.2012 the respondent will be at liberty to file contempt petition against the petitioner before this Court.Petition Dismissed. *******
