JUDGMENT Rajiv Sharma, Judge. Petitioner was transferred/posted in Alsindi Beat, Tatapani Block of Pangana Range of Karsog Forest Division on 1.8.2011. He has now been transferred to Magroo Range of Karsog Forest Division on 30.8.2012. He has not been permitted to complete his normal tenure of three years in Alsindi Beat. Petitioner is a Forest Worker. He being lowly paid employee should not have been transferred to a distant place. The only ground assigned for transferring the petitioner from Alsindi Beat to Magroo Range is that oral complaints were received against him to the effect that he was not discharging his duties diligently. The other complaint placed on record is Annexure R-1 dated 12.11.2010. Petitioner was posted after this complaint at Alsindi Beat on 1.8.2011. The Government employee cannot be transferred merely on the basis of oral complaint. If there is any complaint against an incumbent, he must be given at least an opportunity to explain his position before any punitive/penal action is taken against him. 2. Though, the scope of judicial review in transfer matters is very limited, but in the present case, the transfer of the petitioner from Alsindi Beat to Magroo Range is unreasonable and arbitrary. 3. Accordingly, the present petition is allowed. Annexure P-2 dated 30.8.2012 is quashed and set aside. Respondents are directed to permit the petitioner to discharge his duties at Alsindi Beat. Pending application(s), if any, also stands disposed of. No costs.
