ORDER 1. Petitioners appeared in selection process for appointment on the post of Sub-Inspector of Police. They passed out physical as well as written test and interview then they were recommended for medical examination and District Medical Board found the petitioners to suffer from colour blindness. Accordingly, the petitioners were held unfit for appointment. The petitioners preferred an appeal before the appellate authority. The appellate authority constituted the Medical Board, in which one of the Doctors was eye specialist. When the report was submitted, this Medical Board opined that the petitioners did not suffer from colour blindness. It appears that along with others the petitioners were again sent to the Medical Board in compliance of this Court’s order in relation to other candidates. This 3rd Board again opined that petitioners suffer from colour blindness. In First Medical Board there was no eye specialist and in 2nd and 3rd Board there was one eye specialist in each. 2. In view of the conflicting opinion, this Court thinks it fit and proper to constitute a Medical Board consisting of Principal, P.M.C.H. and Head of the Department of Ophthalmology, and one eye specialist from I.G.I.M.S., Patna. The meeting of the Board shall be convened for medical examination of the petitioners by the Principal, P.M.C.H., Patna within a period of 15 days from the date of receipt/production of a certified copy of this order and report shall be submitted to the I.G. Establishment, Bihar. This report shall be considered to be final and shall be acted upon accordingly. 3. With the above observations, these writ petitions are disposed of.
