ORDER The petitioner, who is the wife of Opposite Party No.1, seeks transfer of Matrimonial case No.191 of 2011 from the Court of Principal Judge, Family Court, Rohtas, Sasaram to the Court of Principal Judge, Family Court, Gaya. 2. It has been submitted that the petitioner was married with the Opposite Party, but she was regularly tortured and neglected, on account of which she was forced to live in her maternal home. It has further been submitted that the petitioner’s father and mother both are old and aged about 80 years and except her no one is looking after them and, therefore, it is difficult for her to attend the court at Sasaram on each date. Under these circumstances, the petitioner seeks transfer of matrimonial case. 3. Notices have been issued to the Opposite Party No.1, who has appeared through duly executed Vakalatnama but none appears on her behalf today. 4. In the facts of the case, the application is allowed and Matrimonial case No.191 of 2011 pending in the Court of Principal Judge, Family Court, Rohtas, Sasaram be transferred to the Court of Principal Judge, Family Court, Gaya. 5. It is expected that the Principal Judge, Family Court, Gaya will dispose off the matter within next nine months on priority basis after giving due notice to the parties. He will also keep in mind the inconvenience of the Opposite Party in appearing on each date and will dispense with his personal appearance if he is not required to be personally present.
