ORDER 1. Delay in filing the application for restoration is condoned. Prayer made in I.A.No.2/2012 – for restoration of appeal is granted. Accordingly, the order passed by this Court on 05.12.2011 is recalled, subject to the appellant depositing a sum of Rs.3,000/- with the Supreme Court Employees' Mutual Welfare Fund within three weeks' time from today. If such deposit is not made, the earlier order passed by this Court stands restored.
