JUDGMENT Rajiv Sharma, Judge: Mr. Vinay Kuthiala, learned Senior Counsel for respondent No. 3 has brought to the notice of the Court notification, dated 29th July, 2004, whereby no modification of timing/return trips/route etc. is permitted within the initial two years of grant of permits and this condition is to be incorporated as an essential condition in the route permit. However, modification can be allowed after one year only in cases where the route has been sanctioned other than the route applied for and the modification is only to be allowed by the Director of Transport. 2. In the instant case, the modification of the root permit has been permitted by the Regional Transport Officer vide Annexures P-2, P-3 and P-5, which is in violation of the notification, dated 29th July, 2004. 3. Accordingly, the writ petition is allowed. Annexures P2, P-3 and P-5 are quashed and set aside. It shall be open to the petitioner to approach the competent authority for redressal of his grievance. However, the modification, if any, shall be carried out strictly as per law. The pending application (s), if any, also stands disposed of. No costs.
