JUDGMENT Mr. Rameshwar Singh Malik J.: (Oral) - The petitioner has approached this Court, by way of instant petition, under Section 439 Cr.P.C., seeking bail in case arising out of FIR No. 63 dated 17.4.2009, under Sections 419, 420, 467, 468, 471, 120-B, 34 IPC registered at Police Station Bawani Khera, Bhiwani 2. Notice of motion was issued. 3. Learned counsel for the petitioner submits that petitioner was not the beneficiary of the transaction in question. In fact, there was no financial transaction with the petitioner. He was only the attesting witness to the agreement to sell dated 5.10.2007. He further submits that even a civil suit is pending between Daya Pal and Dalip Singh, who are real brothers. Learned counsel for the petitioner concluded by submitting that petitioner is behind the bars since 26.4.2012 and no useful purpose would be served by keeping the petitioner in the jail, any further. 4. On the other hand, learned counsel for the State, on instructions from ASI Suresh Kumar, Police Station Bawani Khera, submits that the matter was got re-investigated on the orders passed by this Court and the petitioner has been found to be involved in the case. 5. Having heard the learned counsel for the parties and after going through the record of the case, this Court is of the considered opinion that it is just and expedient to extend the benefit of bail to the petitioner. I say so because the petitioner is about 70 years’ old person. He is not beneficiary to the transaction. He is only an attesting witness to the agreement to sell. Trial in the case is likely to take time. He will face trial but no useful purpose would be served by keeping him behind the bars, any further. 6. The view taken by this Court also finds support from the judgment of the Hon’ble Supreme Court in the case of State of Kerala versus Raneef, 2001 (1) RCR (criminal) 381. 7. In view of the above, the petitioner is directed to be enlarged on bail pending trial, on his furnishing personal bond and surety to the satisfaction of learned trial court. 8. Resultantly, the instant petition stands allowed, accordingly. ---------0.B.S.0------------
