AMARESH KUMAR LAL, J.:–All these appeals have been preferred against the judgment of conviction dated 24th August 2004 and sentence dated 31st August 2004 passed by learned Additional Sessions Judge, Fast Track Court No. 2nd, Aurangabad in Sessions Trial No. 120 of 2001 / 24 / 2002 / 151/2004 arising out of Obra P. S. Case No. 152 of 2000, G. R. Case No. 1542 of 2000 by which all the appellants have been convicted and sentenced to rigorous imprisonment for life for the offence punishable under Section 396 IPC, rigorous imprisonment for seven years under Section 397 IPC, and appellants Md. Aslam, Arvind Kumar Singh and Shambhu Prasad have been further convicted and sentenced to rigorous imprisonment for 10 years under Section 412 IPC and all the seven appellants have been further sentenced to a fine of Rs.5000/- each and in default of payment of fine sentenced to undergo rigorous imprisonment for two years. The sentences were directed to run concurrently, as such all these appeals have been heard together and are being disposed of by this common judgment. 2. It appears that convict Md. Islam had initially preferred jail appeal which was number as Cr. Appeal (D. B.) No. 869 of 2004 but later on a regular appeal i.e. Cr. Appeal (D. B.) No. 1091 of 2010 was filed on his behalf so his both the appeals have been amalgamated. 3. The prosecution case, in brief, is that informant Ambuj Singh (P. W. 2) gave his fard beyan(Ext. 2) before S. I. Ajay Kumar Singh, Officer-in-Charge of Obara Police Station (P.W. 26) on 25.9.2000 at 00.45 hours at Bharub road near tank alleging that on 24.9.2000 at about 10.10 pm. the bus bearing Registration No. B.R.1P 7309 named as Krishna Rath started from Ramesh Chowk, Aurangabad for Patna in which he was a conductor. There were 53 passengers on the bus when the bus reached near Kara More at about 11.15 pm. five criminals in the guise of passengers aged about 25-30 years came to gate of the bus. One of them who was bearing white Paijama Kurta lean and thin aged about 30 years took out Rs.1052/- from his pocket. Lalji Yadav (not examined) Khalasi of the bus protested and a criminal who was bearing fullpant and kurta having 5” height aged about 25 years assaulted him with butt of the firearm on his head.

Soon thereafter third criminal aged about 26 years of small height lean and thin bearing fullpant and kurta having long face assaulted the informant with butt of the pistol on his head. Another criminal aged about 25 years Shyam Colour bearing fullpant and kurta abused and took out bomb from his jute bag and threatened to kill by exploding the bomb. Thereafter, another criminal aged about 28 years shyamala colour of sound health length about 5”6’ speaking magahi entered into the cabin of the bus and at the point of pistol the bus was taken in the eastern side of Bharub More at 11.30 pm the bus was stopped near the tank the criminals started looting the passengers and whoever protested they were assaulted and injured. It has further been alleged that apart from five criminals boarding on the bus seven more criminals aged about 20-25 years armed with pistol and chhura stood up and they also started looting the bus from the rear side. In the meantime, patrolling vehicle came there. After seeing the patrolling vehicle all the accused conveyed among themselves about the presence of police party. After seeing the police party the passengers felt emboldened and tried to catch hold the criminals. Some of the criminals came down from the bus and started firing on the police and also threw bombs. A 35 years unknown passenger caught hold of a criminal who shot fire in the temporal of that passenger and his head was blown. The police came there and followed the criminals cautiously. Five criminals started running towards south and eastern side. The passengers and the police followed the criminals. After hearing the noise of firing and explosion of bomb the villagers of Bharub followed criminals. A twenty eight years old criminal, who had shot fire in the temporal of the passenger causing his death, was apprehended by the villagers and the passengers and he was thrashed brutally. He became senseless, thereafter the police party took him in its custody.

A countrymade pistol and empty cartridge were recorded from his possession. The police party searched the criminals boarding on the bus in the guise of passengers. They were searched and out of their possession countrymade pistol, cartridge, ornaments, torch and Chhura were recovered. In presence of the aforesaid two witnesses the persons from whom the incriminating articles were recovered disclosed their name in presence of the passengers and the police as Kamta Kumar aged about 25 years, Arvind Kumar Singh 25 years, Aslam 25 years, Shambhu Prasad 25 years, Binod Chaudhary 24 years, Ranjeet Kumar Singh 25 years and Deepak Kumar Singh 23 years. A loaded countrymade pistol was recovered from the possession of the accused Kamta Kumar, two golden bangles were recorded from the fullpant of Arvind Kumar Singh, two golden bangles and a countrymade pistol were recovered from the possession of Aslam. Nepali Khukhari (Bhujai) and a silver chain of wrist watch were recovered from the possession of Shambhu Prasad. A big dagger and a torch were recovered from the possession of Binod Choudhary. Two rifle cartridges were recovered from Ranjit Kumar Singh. A chhura and empty cartridge were recovered from the possession of the accused Deepak Kumar Singh. On query by the police it came to notice that four bangles made of gold, one ring and two earrings made of gold were looted from the passenger Nirmala Devi (P.w. 6). A sum of Rs.220/- was looted from her husband Ram Sagar Singh (P.W. 5), Shashikant Singh (P.W. 20) was snatched Rs.80 cash. Wrist watches and altogether four thousand rupees were looted from the passengers by the criminals. It was claimed that informant and passengers of the bus, driver and khalasi can identify the criminals who have fled away. The injured criminal who was apprehended did not disclose his name. 4-5 criminals managed to escape. 4.

Case No. 152 of 2000 dated 25.9.2000 was instituted for the offence punishable under Section 396 and 412 IPC. After investigation charge-sheet was submitted under Sections 396 and 412 IPC against eight named accused and four accused whose name could not be disclosed. Cognizance was taken against all the accused. The case was committed to the Court of Session. Prior to commitment the record of accused Deepak Kumar Singh was split up by order dated 23.11.2000 by the learned Chief Judicial Magistrate and it was transferred to the Court of Juvenile Justice Board. Altogether 10 accused were charged for the offence punishable under Sections 396 and 397 IPC and the accused Arbind Kumar Singh, Md. Aslam and Shambhu Prasad were further charged for the offence punishable under Section 412 IPC to which they denied and claimed to be tried. After trial accused Mukesh Kumar Singh, Kaushal Kumar Singh and Suresh Rajbar were not found guilty and as such they were acquitted for the said charge and appellants were convicted and sentenced as aforesaid. 5. This Court is required to consider and reappraise the evidence as to whether the judgment of conviction and sentence passed by the learned trial court is correct? 6. Learned counsels for the appellants have submitted that learned trial court has failed to appreciate that the appellants were sitting inside the bus as bonafide passengers and they were arrested by the police inside the bus and all criminals alleged fled away, according to the admitted case of the prosecution itself on account of dark night. 26 witnesses have been examined on behalf of the prosecution out of whom P.W. 13 Shahabuddin, P. W. 21 Dharmendra Kumar Mishra and PW. 22 Meraz Ahmad have been declared hostile as none of them has supported the prosecution case. The appellants had also received the injury on their person whose injuries were examined by the Dr. Bhola Prasad Singh (P.W. 25), Medical Officer Primary Health Centre Obra. 7.

It is further submitted that Learned trial court has committed serious error of law in passing the order of conviction on the basis of confessional statement of co-accused before the police as well as all these appellants. The informant Ambuj Singh (P. W. 2) who was conductor of the bus identified only one person and could not identify any other person as it has been mentioned in para 24 of his evidence. P. W. 4 Parmeshwar Leyangi had denied to have seen as to whether the firing was made from outside the bus or inside the bus. P. W. 9 a Judicial Magistrate has also not identified any of the accused criminals. P.W. 10 Umesh Prasad had expressed complete inability to say from whom possession which articles were recovered. P. W. 24 Anjani Kumar Srivastava has also expressed his inability as to who had snatched the belongings. The whole judgment is based of imagination and conjectures. He has further submitted that the driver and conductor of the bus are the important witnesses of the occurrence. Khalasi of the bus was also assaulted by the criminals but none of them has been examined by the prosecution and there has been no explanation for it. 8. Learned counsel for the appellants have further submitted that the evidence of prosecution witnesses is binding on it who have not supported the prosecution case and have been declared hostile. In support of their contention they have referred to the decision in the case of Sanjai Paswan Vs. the State of Bihar, reported in 2012 (1) PLJR 252 and in the case of Raja Ram Vs. State of Rajasthan, reported in (2005) 5 SCC 272. 9. Learned counsel for the State has submitted that it is a case of highway dacoity the passengers and the criminals are unknown to each other. Even the criminals are also unknown to the staff of the bus. In the present case, there were 53 passengers some of them were criminals in the guise of passengers. The aforesaid accused have disclosed their names before the police party as well as the passengers.

One of the accused was assaulted by the passengers as well as the villagers who later on disclosed his name as Ishwar Kahar who had been admitted in the hospital for treatment. Even the passenger who was killed by the accused was unknown to the co-passenger and even at the time of postmortem his name was unknown to the police party as well as other accused and the staff of the bus. Later on, the dead body has been recognized and identified as Munna Prasad son of late Ramchandra Prasad. 10. It is further submitted that it is admitted position that the dacoity was committed in the bus. The accused had been identified by the witnesses by their face and stature in the light of bus. Learned trial court has considered the prosecution evidence and has rightly convicted and sentenced the appellants and no interference by this Court is required. 11. After hearing learned counsel for both the parties and on perusal of record it appears that occurrence of dacoity has not been denied even by the appellants. The prosecution has examined 26 witnesses. On 26.9.2000 P. W. 1 Satya Prakash Mishra, Judicial Magistrate has recorded the statement of eight witnesses under Section 164 Cr.P.C. The statement of Sunil Kumar Mishra (P.W. 9), Umesh Pathak, Ram Sagar Singh (P.W. 5), Md. Shahabuddin (P.W. 13), Balram Yadav, Anjani Kumar Srivastava (24), Umesh Kumar Singh, Akhilesh Kumar Singh and Lalji Yadav have been marked as Exts. 1 to 1/7. 12. P. P.Ws. 4, 8, 10, 11, 12, 14, 15, 16, 17, 18, 23 and 26 are police officials. P.W. 26 is the Investigating Officer of this case. P.Ws. 4, 11, 12, 13, 24, 26 are the members of the raiding party. P. W. 3 Rambriksha Singh is a formal witness who has produced the bangles in the Court which has been marked material Ext. 1. In his cross-examination he has stated that there is no identification mark on the aforesaid articles. He does not know from where they have been brought. P. Ws. 6, 13, 21, 22 have been declared hostile by the prosecution. Their evidence will be considered later on. 14. P. W. 2 Ambuj Singh is the informant and conductor of ill fated bus and also the victim of the occurrence. He has stated that he was the bus conductor of Krishna Rath bus bearing Registration No. B R 1P 7309. It started from Aurangabad bus stand at 10.10 pm. for Patna. The bus was full of passengers. When the bus reached at Kara More a passenger of the bus armed with pistol started teasing him. He abused him and demanded money, when the conductor refused another passenger came to him armed with pistol and assaulted him in his head causing injury. The khalasi was also injured by them. He has further stated that one of the criminals took out Rs.1052/- from his pocket. That accused was aged about 25 to 29 years. The accused were speaking Magahi language. The bus reached at the place of occurrence at about 11 pm.

An accused went in the cabin of the bus and snatched ornament of a lady passenger and also assaulted her. One of the criminals pointed pistol in the temporal of the driver and asked him to take the bus towards Bharub More and after half kilometer the bus was stopped at the instance of criminal near a pond. There were five criminals in the bus who were armed with pistol, diagger and Bhujali. In the meantime, the patrolling party came there. The criminals threw bomb on the police vehicle. He has further stated that the criminals were in the guise of passengers. One of the passengers challenged the criminals who shot fire in his temporal and the passenger died in the bus. The villagers of Bharub came there and they tried to catch hold of the accused who were escaping. One of them was apprehended and the remaining fled away. Four bangles, ear ring and rings were recovered from his possession. The criminals also looted money and wrist watch of the passengers. He has identified the criminal who was apprehended and disclosed his name as Ishwar Kahar. He has stated that he does not identify any other accused. He has further stated that his statement was recorded by Ajay Kumar Singh, Officer-in-Charge of Obra Police Station (P. W. 26). After recording his statements the contents thereof were read over and explained to him and after finding them correct he put his signature. He has identified his signature on the fard beyan (Ext. 2). 15. P.W. 4 has stated that on 24.9.2000 he was in raiding party headed by Ajay Kumar Singh in Obera P. S. Case No. 136, 140 and 141 of 2000 and this fact has been mentioned in the police station case-diary. When the raiding party reached near Bharub More at about 10.30 pm. there was a sound of firing and police party went towards the direction from where sound of firing was made. After going at a distance of half kilometer he saw that there was firing between police and the criminals. There were 8-9 rounds of firing.

Firing was also made at the instance of Officer-in-Charge from the police party. During that firing one of the accused was apprehended who was injured and in senseless condition. He was taken to government hospital for treatment. He cannot identify him today. The police party searched the passengers and the criminals in the bus. Seven criminals were apprehended from the bus from whose possession countrymade pistol, chhura, torch and ornaments were recovered. Those seven persons were apprehended and seizure list was prepared by S. I. Ram Sakal Rai, S. I. Amerika Rai, Ajay Kumar Singh (P.W. 26) and A S I Sainul Haque. He has identified the seizure list which was prepared by him and a copy of the same had been given to the accused which has been marked as Ext. 3. Seven criminals were apprehended from the bus. From whose possession incriminating articles were recovered are Kamta Prasad, Shambhu Prasad, Arjun Kumar, Arbind, Binod Chaudhary and Deepak. He does not remember the name of accused criminals who had accepted their involvement in the occurrence. 4-5 accused escaped. He has stated that as the occurrence has taken place long ago he cannot identify all the accused. This witness has identified Binod Chaudhary, Arbind, Shambhu and Ranjeet in the dock. The man who was identified as Arbind has disclosed his name as Kamta. He has further stated that a passenger of the bus was killed during commission of dacoity. He has been cross-examined at length. It appears that his evidence is convincing and fit to be relied upon. 16. P. W. 5 Ram Sagar Singh is the passenger of ill fated bus. He has stated that he was going to Patna by the bus with his wife when the bus reached near Bharub More there was occurrence of looting in the bus. He has further stated that there was 4-5 persons in the bus who were threatening to kill and abusing the driver of the bus. At the point of pistol the bus was taken in the Kachchi road by the driver.

All the accused were armed with pistol and Katar. He has also stated that the accused looted the ornaments of his wife and about Rs.200/- was looted from him. In paragraph 6 he has stated that he and his wife had identified the bangles of his wife in the T I Parade which was conducted by Anchal Adhikari in the Obra Police Station. He has further stated that during the occurrence of looting there was firing between the police and the accused. The people from neighbouring village came there. He has also stated that in the bus a passenger was killed by firing shot. He has identified accused as Ishwar who had shot fire causing the death of a passenger. When the accused Ishwar was escaping he was assaulted by the police and the villagers. He has stated that 6-7 accused were apprehended from the bus. He cannot identify them. The persons who were apprehended from the bus disclosed their name in the police station. He remembers only Ranjeet Kumar Sinha and Aslam as dacoits who were apprehended from the bus. He is not able to identify material Ext. 1. On recall in paragraph 24 he has stated that inquest report was prepared by the Officer-in-Charge Ajay Kumar Singh P.W. 26 which was witnessed by him. He has identified his signature Ext. 4. 17. P. W. 6 has also stated that she was going to Patna by Krishna Rath Bus with her husband when the bus reached near Bharub More the bus was turned towards East leaving road leading to Patna. The bus was taken towards half-kilometer east. Some criminals were riding on the bus who assaulted the conductor and also to her. They also assaulted the driver of the bus when the bus reached Bharub more the criminals committed loot. They looted her bangles, ear ring and other ornaments and money was also looted. She has also stated that passenger who was sitting behind the driver of the bus was killed by fire shot. His dead body fell on her leg. Soon thereafter the police came there and there were firing from both sides.

She has identified the accused Ishwar in the Court and says that he is the person who has looted her and assaulted her. He has also stated that beside Ishwar 4-5 accused persons were also apprehended. She does not remember their name. After seeing material Ext. 1(bangles) she says that those do not belong to her. Her bangles were made of gold. Although she has been declared hostile by the prosecution but she has supported the factum of dacoity with murder in the bus. 18. P. W. 7 has stated that on 24.9.2000 he was boarding in Krishna Rath bus which started from Aurangabad to Patna at quarter past 10 P.M. When the bus reached near Bharub More 5-6 persons raised alarm and started looting the bus from back portion of the bus. They were armed with firearm and Chhura. The bus was taken half kilometer towards Bharub village. After turning it the criminals assaulted conductor and Khalasi. He was also assaulted with butt of revolver. His golden chain and Rs.2000/- cash were snatched by the criminals. A man sitting behind driver of the bus was killed by the criminal. The criminals also looted the other passengers. The criminal who had shot dead a passenger was apprehended by the public and he was assaulted. In the meantime, the police party came there. There was firing and counter firing between the police and the criminals. Seven persons who were committing loot in the bus were apprehended. Since he was injured, he was also taken to hospital. Seven persons apprehended by the police disclosed their name before the public as Ranjeet Kumar Sinha, Kamta Kumar, Md. Aslam, Deepak Kumar Singh. He does not remember the name of other criminals. He came to know the name of the accused who had shot dead a passenger as Ishwar Kahar. He has also identified him in the Court. He has also stated that he cannot identify the other accused person whose name had been disclosed.

In his cross-examination he has stated that he was sitting on Seat No. 1 of the bus. He was assaulted by the criminals in the bus. First of all there was attack of the criminals with conductor and Khalasi. He has also stated that he had never seen the accused who were apprehended by the police prior to the occurrence. 19. P. W. 8 is one of the members of patrolling party. He has stated that a Krishna Bus going to Patna turned towards east near the Bharub More leaving the main road. He suspected some foul play and asked the members of the patrolling party to be alert and follow the bus. When the bus went about half kilo-meter in the east, the criminals started looting the passengers and the passengers started making noise. As soon as the police party came there the criminals started firing. In the meantime, the police officer-in-charge and other police came from western side and surrounded the bus. Seven criminals from the bus were apprehended and one criminal who was injured outside the bus was apprehended. Criminals were assaulted by the passengers. Some of the criminals fled away in the garb of darkness. A passenger of the bus was killed by fire shot in his temporal. The apprehended criminals were searched. Countrymade pistol, bangles, bhujali, chhura, ornaments and cartridges were recovered from their possession. The criminals who was in senseless condition his person was also searched. A countrymade pistol and empty cartridge were recovered from his possession. He prepared the seizure list of the articles which were recovered from the possession of the senseless criminal. It was witnessed by Balram Yadav and Lalji Yadav. He has identified the seizure list (Ext. 5). He has also identified other seizure list prepared by S. I. Parmeshwar Leyangi as Ext. 6. He has also brought the pistol and cartridge which have been marked material Exts. II and III. He has identified the accused Aslam, Ranjeet, Arvind, Binod and Kamta Prasad in the dock as the criminals apprehended from the bus.
5). He has also identified other seizure list prepared by S. I. Parmeshwar Leyangi as Ext. 6. He has also brought the pistol and cartridge which have been marked material Exts. II and III. He has identified the accused Aslam, Ranjeet, Arvind, Binod and Kamta Prasad in the dock as the criminals apprehended from the bus. This witness has identified Kamta Prasad whose name is Shambhu Prasad. In his cross-examination he has stated that police party reached at the place of occurrence at about 11.50 pm. they followed the criminals for about 10 minutes. It was a dark night. The public from adjacent village had also come there. He has also stated in paragraph 16 that he has seen the criminals for the first time on the date of occurrence. He has stated that eight seizure list had been prepared at the place of occurrence. He has denied the suggestion of accused that all the accused fled away and the bus passengers have been falsely implicated in this case. 20. P. W. 9 is also a judicial magistrate who was also going to Patna by the ill fated Krishna Rath bus. He has stated that when the bus went ahead Obra some criminals started looting at the point of arms and ammunition. He was also relieved Rs.3000/-, wrist watch and were also searched by the criminals. When the bus was moving, the police party came. Some criminals fled away, some of them were apprehended by the police. He cannot name them. He came to know that one of the passengers assaulted by the criminals died. He has also stated that his statement was recorded by the Judicial Magistrate at Aurangabad Civil Court under Section 164 Cr.P.C. on 26.9.2000. His statement has already been marked as Ext. 1. He has stated that he cannot identify any of the criminals on the date of deposition. In his cross-examination, he has stated that it was a dark night. The light of the bus was on but it was dim. 21. He has stated that when the bus went ahead about two kilometer of Obra police station. The criminals sitting behind the bus armed with firearm started assaulting and looting the passengers.

The bus was turned at the instance of the criminals. When the bus travelled about one kilometer the police came from behind, the accused made firing and started moving. One of the criminals was apprehended by the villagers and he was assaulted by them. He has also stated that a passenger sitting behind the chair of the driver was killed by the criminal. He cannot identify the criminals. His statement has been recorded by the magistrate which has been marked as Ext. 1/1. In his cross-examination he has also stated that during search incriminating article and looted materials were recovered from the criminals. 22. P. W. 11 has stated that he was a member of the police party which was going to make raid. He has stated that after getting information that Krishna Rath bus had been taken towards east and police party was following it, his police party also went towards that direction. After reaching near the bus he saw that the police party was following the criminals. There was firing from both sides. The villagers of Bharub were also helping to apprehend the criminals. The criminals also killed a passenger in the bus. Criminals looted passengers of the bus. One of the accused who could not escape was apprehended by the villager and he was assaulted by them. Seven accused persons who were looting the bus, were apprehended from the bus. The apprehended criminals disclosed their name. He had also prepared a seizure-list out of the articles recovered from accused Binod Chaudhary a copy of which was given to him. A chhura and two cell torch were recovered from the possession of the accused. He has stated that as two years of the occurrence had passed, he cannot identify the accused by name and he has identified the accused by face in the Court. 23. P.W. 12 has also supported the prosecution case as P. W. 11. He has also stated that a passenger who was shot dead, was later on identified as Munna.

He has also stated that knife and empty cartridge were recovered from Deepak Kumar. Two cartridges were recovered from the possession of Ranjeet Kumar. He also prepared the seizure-lists which have been marked as Ext. 8 and 8/1. A copy whereof had been given to both the accused Ranjeet and Deepak. He has also identified seized articles which have been marked as material Exts. (iv), (v), (vi) and (vi/1). This witness has identified Binod, Shambhu, Kamta Kumar, Ranjeet Kumar and Ishwar Kahar in the dock. In his cross-examination he has stated that at the time he had gone to Jehanabad in Obra P. S. Case No. 136 of 2000. In paragraph 16 he has stated that bus tickets from Aurangabad to Patna were recovered from the possession of criminals. 24. P. W. 14 has also supported the prosecution case as P. W. 12. He has stated that 4-5 criminals escaped. One of them was apprehended by the help of villagers. He was assaulted by the villagers. The bus was searched seven criminals were apprehended with arms. They disclosed their name as Binod Chaudhary, Kamta Prasad, Ranjeet, Aslam, Shambhu, Arvind and Deepak. He had searched the person of Aslam and Kamta. Two seizure lists were prepared. Two bangles were recovered from the fullpant of Aslam. A countrymade pistol was recovered from the possession of Kamta Prasad. Two seizure lists were prepared by him which have been marked as Exts. 9 and 9/1. A copy of the same had been given to both the accused. He has also identified the accused Ranjeet, Shambhu, Kamta, Ishwar, Binod and Aslam in the dock. 25.
A countrymade pistol was recovered from the possession of Kamta Prasad. Two seizure lists were prepared by him which have been marked as Exts. 9 and 9/1. A copy of the same had been given to both the accused. He has also identified the accused Ranjeet, Shambhu, Kamta, Ishwar, Binod and Aslam in the dock. 25. P. Ws, 15, 16, 17 and 18 are constables of the police party. They have also supported the prosecution case and have also stated that one of the passengers was killed in the bus. Total eight criminals were apprehended. Incriminating articles have been recovered from their possession. P. W. 15 has identified accused Ishwar, Aslam and Binod in the dock. P. W. 16 has identified Aslam, Ishwar Kahar and Binod Chaudhary in the Court. P. W. 17 has also identified the accused Ishwar Kahar in the dock. He has also stated that accused Arvind, Deepak, Aslam, Binod and Ranjeet were apprehended. He has also stated that he has identified Binod, Aslam, Shambhu and Arvind in the dock. P. W. 18 has stated that one criminal was chased and assaulted by the villagers. One passenger was killed in the bus. Seven criminals were apprehended from the bus who were sitting and hiding in the bus with passengers. He has identified Ishwar Kahar and Ranjeet by face in the dock. 26. P. W. 19 Dr. T. N. Shukla was Medical Officer posted in Sadar Hospital Aurangabad and the post-mortem examination was held by him of the dead body of an unknown person aged about 35 years Hindu male on 25.9.2000. The dead body was brought and identified by the constable. Rigor mortis was present on whole body. The following ante-mortem injuries were found on his body. (i) Brain material was lacerated and membranes of brain were not present. (ii) All bones of skull like parietal, occipital and frontal both were not present. (iii) Tatooing and blackness and inverted margin burnt out wound on the left submandibular area and the wound was circular. The heart part were empty. Large vessels were callapsed and stomach contains digested food materials. Time elapsed since death and post-mortem examination held within 12 to 24 hours. In the opinion of the doctor injuries were caused by firearm weapon leading to haemorrhage, shock and untimely death. He has identified the post-mortem report as Ext. 10.

P.W. 20 has stated that he was also going to Patna in the aforesaid illfated bus and was sitting in the cabin of the bus. When the bus went ahead Obra town. A hulla was raised that the criminals sitting in the bus were looting the passengers. Two passengers entered into the cabin. One of them overpowered the driver and got turned the bus in Kachchi road towards the village. The passengers were being looted by the criminals. The police patrolling jeep was following the bus. After stopping the bus criminals began to escape. About six hundred rupees was also looted from him. One of the criminals shot fire at a passenger who died. One of the criminals was apprehended. The passenger who died was adjacent to this witness. He has further stated that he did not identify any of the accused. He has also been cross-examined. 28. P. W. 21 is a witness to the Inquest report. He has identified the signature (Ext. 4/1) on inquest report. He has stated that the occurrence took place in the night of 24.9.2000 when he was travelling by Krishna Rath. His father was also with him. The occurrence of loot was held in the bus. Some of the criminals causing loot were apprehended. He has stated that he does not know as to whether they had disclosed their names. He has been declared hostile by the prosecution. In his cross-examination by the prosecution he has stated that it is not a fact that he has stated before the police that there were about 15 criminals looting the passengers of the bus. Seven out of them were apprehended. One passenger was killed by the criminal who was apprehended by the villagers and the police and severely assaulted. He has denied that he has stated before the police that the criminals were armed with pistol, chhura and torch which were recovered from their possession.

It appears from the evidence of P.W. 21 and P.W. 22 that the occurrence of dacoity had taken place in the bus. Although they have not stated the names of dacoit. 30. P. W. 23 is a member of raiding party. He has deposed like P.W. 4 and has supported the prosecution case. He has stated that seven criminals were apprehended from the bus. They had disclosed their names as Dipak, Shambhu, Binod, Ranjeet, Arbind and Aslam. He forgot the name of one of the criminals. He has also stated that incriminating articles were recovered from their possession. Seizure-lists were prepared. He has also stated that one of the accused was also apprehended by the public who was assaulted brutally. He could not disclose his name. He has stated that he cannot identify the accused by name. He can identify them by face. He has named the accused Ishwar Kahar who was apprehended by the public. He has identified the injury reports eight in number which have been marked Exts. 11 to 11/7. He has also identified another report which has been marked as Ext. 11/8. In para 16 he has stated that he did not see any one making fire shot. 31. P. W. 24 was a passenger of the bus. He has stated that his statement was recorded by the Judicial Magistrate under Section 164 Cr.P.C. He has identified his writing and signature which has been marked as Ext. 1/5. He has also stated that Akhilesh Kumar Singh was also travelling by the aforesaid bus. His statement was also recorded by the Judicial Magistrate S. P. Mishra under Section 164 Cr.P.C. He has identified his signature as Ext. 1/6. In his cross-examination he has stated that his articles were also snatched in the occurrence. He cannot identify any of the dacoits. 32. P. W. 25 Dr.

W. 25 Dr. Bhola Prasad Singh was posted as Incharge Medical Officer, Primary Health Centre Obra Aurangabad and he examined the injured persons of the ill fated bus on 25.9.2000. At 1.15 a.m. he examined Basishtta Narayan Singh (P.W. 7) and found the following injuries on his body. (i) lacerated wound with irregular margin reddish in colour on left side fore head 1” x ½” scalp deep. Age of injury about six hours caused by hard and blunt substance. Injuries were simple in nature. His injury report has been marked as Ext. 11/9. At the same time, he has also examined Laljee Yadav and found following injury:- (a) Swelling on right side of fore head Size:- ½” in diameter. Age of the injury six hours caused by hard and blunt substance, nature simple. His injury report is Ext. 11/10. He has also examined Ambuj Singh (P.W. 2) on 25.9.200 at 1 a.m. and found following injury :- (a) Swelling and tenderness on back of head, 1” in diameter, age of injury about six hours caused by hard and blunt substance, nature simple. His injury report has been marked as Ext. 11/11. On 25.9.2000 P.W. 25 has also examined following accused Ranjit Kumar Singh @ Ranjit Kumar Sinha ( appellant no. 1 of Cr. Appeal (D.B.) No. 664 of 2004), Arbind Kumar Singh (appellant of Cr. Appeal (D. B.) No. 709 of 2004), Shambhu Prasad (appellant no. 2 of Cr. Appeal (D. B.) No. 664 of 2004), Binod Chaudhary (appellant of Cr. Appeal (D.B.) No. 774 of 2004), Kamta Kumar son of Chandrashekhar Singh (appellant of Cr. Appeal (D.B.) No. 717 of 2004) and Md. Aslam (appellant of Cr. Appeal (D.B.) No. 869 of 2004 later on filed Cr. Appeal (D.B.) No. 1091 of 2010) and found no injury on their person except complaint of pain in their whole body. He has also stated that he had provided available medicine to the injured. 33. P. W. 26 Ajay Kumar Singh is the Investigating Officer. He has stated that on 24.9.2000 he was posted as Officer-in-Charge of the Police Station. He was going to make raid in connection with Obra P. S. Case No. 176 of 2000 along with the police personnel when the raiding party reached Bharub turning. On query chaukidar informed that a bus had gone ahead towards the village and the police patrolling party was following it. In the meantime, there was noise of firing. He along with police personnel went ahead and asked the police personnel to follow the bus. He reached at the place of occurrence after firing was over and seen Krishna Rath Bus No. BRIP7309. The injured was senseless. The looted materials of the passengers had been recovered from the criminals. He was told that an unknown passenger had been killed by the person who was injured and senseless. He recorded the fardbeyan (Ext. 2) of Ambuj Singh (P.W. 2). Balram Yadav (not examined) had witnessed the fard beyan. On the basis of which Obra P. S. Case No. 152 of 2000 was instituted. The criminals confessed their guilt. He recorded the confession of the accused Ranjit Kumar Singh, Shambhu Prasad, Binod Chaudhary, Kamta Kumar, Dipak Kumar, Arbind Kumar Singh and Md. Aslam which has been marked Ext. 12 to 12/6. He has also recorded the statement of witnesses Balram Yadav, Lalji Singh, Ram Sagar Singh, Akhilesh Kumar Singh, Sunil Kumar Mishra, Umesh Pathak, Anjani Srivastava and Sahabuddin under Section 164 Cr.P.C. before the Judicial Magistrate Satya Prakash Mishra (P.W. 1). He also got the test identification parade done of the articles looted from the bus passenger. The articles were identified by Ram Sagar Singh (P.W. 5) and (P.W. 6).

The person who was killed in the bus was identified as Munna Prasad, son of late Ram Chandra Prasad of village Dhanab, P.S. Bodh Gaya, District Gaya at present of Mohalla Bararpur, PS and District Aurangabad. He came to know that the passengers who were found sensless had caused the death of a passenger in the cabin of the bus. The name of the accused is Ishwar Kahar @ Bhelba. After investigation he submitted charge-sheet showing the accused Suresh Rajbar, Gopal Kahar, Nabahi Yadav, Kaushal Kumar, Mukesh Kumar Singh as absconder. He has further stated that he identified all the accused. He has stated that page no. 1 to 98 of the case-diary is in his pen and signature which has been marked as Ext. 13. He has stated that witnesses Meraj Aham (P.W. 22) and Sahabuddin (P.W. 13) had also supported the prosecution case before him. In his cross examination he has stated that the photograph of the bus was not taken as there was no photograph in the night. The photo of dead body was taken. There were 53 passengers in the bus, criminals were out of them. He has stated that he had not made any firing as such he cannot say as to how many firing was made by the police party. He had to prepare inquest report. He reached the place of occurrence on 25.9.2000 at 00.45 hours. He took about 8 hours in completion of formalities on the place of occurrence. He has stated that in paragraph 22 of the case-diary he has mentioned that the villagers and the passengers had assaulted the accused. He has further stated that five dacoits fled away which was narrated by the informant and the witnesses. He has been cross-examined at length. He has also stated that he came to know during investigation that injured and senseless criminal Ishwar Kahar was the gang leader of the criminals. He has stated that none of the witnesses had told the names of criminals only the witnesses had stated the figures and physical identify of the criminals. 34. Following are material exhibits:– Ext. No witness has been examined on behalf of the defence. However, a certified copy of the deposition of P.W. 3 Amerika Ram S. I. Muffasil Police Station, Aurangabad examined in Sessions Trial No. 11 of 2002 / 15 of 2003 has been filed which has been marked as Ext. A. 36. All the appellants have been convicted under Section 396 and 397 IPC. “dacoity” has been defined in Section 391 IPC which reads as follows:– “391. Dacoity.–When five or more persons conjointly commit or attempt to commit a robbery, or where the whole number of persons conjointly committing or attempting to commit a robbery, and persons present and aiding such commission or attempt, amount to five or more, every person so committing, attempting or aiding, is said to commit “dacoity’.” Robbery has been defined in Section 390 IPC. It is better to quote Section 390 IPC;– “390. Robbery.–In all robbery there is either theft or extortion. When theft is robbery.–Theft is “robbery” if, in order to the committing of the theft, or in committing the theft, or in carrying away or attempting to carry away property obtained by the theft, the offender, for that end, voluntarily causes or attempts to cause to any person death or hurt or wrongful restraint, or fear of instant death or of instant hurt, or of instant wrongful restraint. When extortion is robbery.– Extortion is “robbery” if the offender, at the time of committing the extortion, is in the presence of the person put in fear, and commits the extortion by putting that person in fear of instant death, of instant hurt, or of instant wrongful restraint to that person or to some other person, and, by so putting in fear, induces the person so put in fear then and there to deliver up the thing extorted. Explanation.–The offender is said to be present if he is sufficient near to put the other person in fear of instant death, of instant hurt, or of instant wrongful restraint.” 37.

From perusal of the prosecution witnesses we find that it is a case of highway dacoity of the aforesaid passenger bus. The accused including the appellants were also sitting in the bus in the guise of passengers. The bus was going from Aurangabad to Patna, in the way the criminals started looting the passengers and also the informant (P.W. 2), who was the conductor of the bus, at the point of firearm and other arms. At the point of arms by the criminals, the bus had been taken in the kachhi road after retracting from highway which was the main pacca road for going to Patna. The passengers were unknown to the informant as well as the prosecution witnesses, who were the passengers of the ill fated bus known as Krishna Rath going from Aurangabad to Patna in the night of 24.9.2000. After looting the passengers of the bus the bus was stopped and the criminals started escaping. The police party had been following the bus. After challenge by the police, firing was made by the criminals including the appellants which was retorted by the police party. The appellant Ishwar Kahar was assaulted by the villagers. He was injured and senseless. He was apprehended by the police party. The police party searched the bus and the accused including the appellants were found in possession of firearms and other arms and looted articles were recovered from their possession. Since the appellants were unknown to the passengers they could not identify them. Some of the passengers have identified them by face during the trial. Passengers of the bus were also unknown to each other as such one of the passengers who was shot dead by the accused Ishwar Kahar has also not been named by the doctor who has held the post-mortem examination. Later on, the dead body has been identified as Munna Prasad, son of Late Ram Chandra Prasad as has been stated by Investigating Officer (P.W. 26). P.Ws. 2, 4, 5, 7, 8, 9, 10, 11, 12, 14, 15, 16, 17, 18, 20, 23, 24, and 26 have supported the prosecution case. P.W. 6 Nirmla Devi has been declared hostile but her evidence supports the prosecution case.

Parade but during deposition she has not identified materials. It also appears from the evidence of P. Ws. 13, 21, 22 that although they are hostile but it appears from their evidence that the dacoity has been committed in the bus by the accused including the appellants. The evidence of prosecution witness is quite natural. They have supported the factum of dacoity in the bus. The passengers P.Ws. 5 and 7 have identified some of the appellants to have committed the dacoity and murder. The passengers P.Ws. 6, 20, 21, 22 and 24 have supported the occurrence of dacoity and murder of a co-passenger. Police officials P.Ws. 4, 8, 10, 11, 12, 14 to 18 and 23 are members of the patrolling party as well as some of them are Raiding party, who have reached the place of occurrence following the aforesaid bus as it came to their notice that the aforesaid bus was waylaid by the criminals in the guise passengers to the kachchi road leaving the main road. The police patrolling party smelled some faul play when the bus was turned towards the kachchi road. This party was followed from the police raiding party which was going to raid in some other criminal case. After seeing the police party the criminals in the guise of passengers started making firing and throwing bomb on the police party which was returned by firing by the police. The criminals started escaping. After hearing the sound of firing and noise made by the passengers the villagers of Bharub followed the criminals. One of the criminals was apprehended and thrashed by the villagers who was later on identified as Ishwar Kahar @ Bhedwa. He has been also identified by the passengers of the bus to have shot dead an unknown passenger of the bus, who was later identified as Munna Prasad after the post mortem examination. On search arms and looted articles were recovered from the possession of Ishwar Kahar (appellant). 38.

The bus was searched by the police party and seven criminals who were in the guise of passengers were apprehended. Arms, ammunitions and looted articles were recovered from their possession. Seizure lists (Exts. 5 to 9/1) were prepared. The apprehended criminals disclosed their names before the police and the passengers who are the appellants and one Deepak Kumar Singh, whose case was transferred to the Juvenile Justice Board on the ground of his juvenility. 39. In this case we find that there is strong circumstance and the chain of circumstances which lead to only conclusion that the appellants have committed offence of dacoity with murder in the aforesaid ill fated bus in which Munna Prasad was killed by the appellant Ishwar Kahar @ Bhedawa (appellant of Cr. Appeal (D.B.) No. 722 of 2004). The appellants have committed the offence punishable under Section 396 and 397 IPC. Since the looted articles, bangles have not been identified by P. W. 6 Nirmala Devi, her bangles were looted by the dacoits as such we find that the offence punishable under Section 412 IPC has not been proved beyond all reasonable doubts as such the appellants Arvind, Aslam and Shambhu Prasad are acquitted from the charge under Section 412 IPC by giving them the benefit of doubt. 40. We find that there is a chain of circumstantial evidence which clearly establishes by reliable and clinching evidence and the circumstances and chain of events form irresistible conclusion about guilt of the appellants and no other hypothesis against the guilt is possible. We find that there is no material on the record to show that there is any enmity with the appellants and the prosecution witnesses. It is settled principles of law that it is the duty of the Court to unravel the truth under all circumstances. Undue importance not to be given to minor discrepancies which do not shake basic version of prosecution case. Entire evidence must be evaluated by excluding exaggerated version as witnesses keep adding embellishments to their testimony. If a witness is otherwise trustworthy, then his evidence should not be disbelieved.

If major portion is found to be deficient and residue is sufficient to establish guilt of accused, then courts must separate grain from chaff. It has to be appraised in each case as to what extent evidence is admissible. If courts consider some portion of evidence as insufficient or unworthy, it does not mean as a matter of law that entire evidence must be disregarded in all respects. In this connection a decision in the case of Ramesh Harijan Vs. State of Uttar Pradesh, reported in (2012) 5 SCC 777 may be relied upon. 41. In the facts and circumstances stated above, in our opinion the decisions reported in 2012 (1) PLJR 252 and (2000) 5 SCC 272 do not affect the merit of the prosecution case. 42. Considering the facts and circumstances stated above we do not find any ground to interfere with the impugned judgment except conviction under Section 412 IPC with regard to appellants Arbind Kumar Singh (in Cr. Appeal (DB) No. 709 of 2004), Md. Aslam (in Cr. Appeal (DB) No. 869 of 2004 and later on Cr. Appeal (DB) No. 1091 of 2010) and Shambhu Prasad (in Cr. Appeal (DB) No. 664 of 2004). Accordingly, the judgment of conviction and sentence is modified to this extent. 43. In the result, all the appeals are hereby dismissed. 44. The bail bonds of appellants Ranjit Kumar Singh @ Ranjit Kumar Sinha and Shambhu Prasad (in Cr. Appeal (DB) No. 664 of 2004), Arbind Kumar Singh (in Cr.
