JUDGMENT Mr. Ram Chand Gupta, J.: (Oral) - The present petition has been filed for anticipatory bail under Section 438 of Code of Criminal Procedure in FIR no. 100 dated 18.03.2012, under Sections 406/420/467/468/471/120B IPC, registered at police station DLF Qutab Enclave, District Gurgaon. 2. I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned Additional Sessions Judge, Gurgaon dismissing bail application filed by the petitioner. 3. Brief allegations against the petitioner-accused are that, he is brother of husband of complainant. After death of husband of complainant, he had withdrawn amounts by forging cheques from the accounts of her deceased husband -Sushil Kumar Sharma. 4. It has been contended by learned counsel for respondent-State that the deceased husband of complainant was having two bank accounts and total fraudulent withdrawal from the accounts of deceased husband of complainant comes to Rs.1,46,000/-. 5. It has been contended by learned counsel for the petitioner-accused that it is a family dispute and that as per order of this Court, petitioner also wanted to get the dispute settled and that he had offered to pay Rs.30,000/- to complainant. It is also contended that petitioner has also deposited certain amount in the account of his brother after his death. 6. On the other hand, it has been stated by learned counsel for complainant as well as by learned counsel for the respondent-State that no amount was paid by the petitioner to respondent-complainant and that after the death of her husband she was subjected to cruelty by petitioner and family members and she was turned out of the matrimonial home alongwith minor child, who is now aged two years. 7. Hence, in view of serious allegations against petitioner-accused, it is not such a case in which extra-ordinary relief of anticipatory bail should be granted to the petitioner-accused. 8. Without expressing any opinion on the merits of the case, the instant application for anticipatory bail filed by Vijay Kumar Sharma is, hereby, dismissed being devoid of merit. 9. Interim order dated 02.04.2012 already granted in his favour stands vacated. ---------0.B.S.0------------
