ORDER Heard learned counsel for the Petitioner and the State. 2. The Petitioner seeks quashing of the entire proceeding including the order of cognizance dated 29.8.2008 passed in Trial No. 1914 of 2008, G.R. No. 71 of 2005 arising out of Lakhnour P.S. Case No. 12 of 2005 by which Judicial Magistrate, 1st Class, Jhanjharpur has refused to discharge the Petitioner. 3. The case of the Informant is that certain persons were intercepted on the eve of Election with licensed arms and huge amount of money. It was suspected that the money was being carried for allurement of the Voters. 4. The submission of the Petitioner is that it was merely on speculation that the present First Information Report has been filed. 5. Considering the nature of allegation in the First Information Report, the application is allowed and the entire proceeding including the order of cognizance dated 29.8.2008 passed by the Judicial Magistrate, 1st Class, Jhanjharpur, in connection with Trial No. 1914 of 2008, G.R. No. 71 of 2005 arising out of Lakhnour P.S. Case No. 12 of 2005 is, hereby, quashed. ?
