JUDGMENT 1. This appeal has been directed by the injured in a road accident seeking enhancement of compensation. 2. The road accident was on 02.09.2006. In this accident, appellant sustained multiple injuries. Tribunal awarded him Rs.90,000/-. 3. According to the learned counsel for the appellant, the Tribunal awarded monetary compensation disproportionate to the sufferings of the appellant. Very less compensation has been awarded for disability and also under other heads, further certain other heads were omitted. 4. On the other hand, the learned counsel for the second respondent would contend that what was awarded by the Tribunal itself is on the higher side. 5. I have anxiously considered the rival submissions, perused the materials on record and the award of the Tribunal. 6. The road accident was on 02.09.2006. Then, the appellant was 27 years old. He is a J.C.P. Operator. He has sustained multiple injuries on his left thigh and right shoulder (See Ex.P.4 Copy of the Accident Register). He has been hospitalised from 05.09.2006 to 11.09.2006 (See Ex.P.5 Discharge Summary). P.W.2 examined him and determined his disability at 34% (See Ex.P.8 Certificate). This has been accepted by the Tribunal. 7. The learned counsel for the appellant submitted that it is a fit case for invoking multiplier method. There is no complete loss of mobility of his limbs, nor his earning capacity. In the facts and circumstances and considering the medical evidence it is not a fit case for adopting multiplier method. However, in the facts and circumstances of the case, Rs.35,000/- awarded for disability is on the lower side. It is raised to Rs.68,000/-at the rate of Rs.2,000/- per percentage. 8. Towards transportation charges and extra-nourishments Rs.3,500/- and Rs.3,000/-respectively are awarded by the Tribunal. It is increased to Rs.5,000/- each. The appellant has been hospitalised for 7 days. He has undergone surgical treatment. After discharge, he would have been immobilised for a considerable period. There is loss of income during his treatment period. As per Ex.P.10 Salary Certificate, spoken to by P.W.3, he was paid Rs.18,000/-per month. Towards loss of income during the treatment period Rs.18,000/- is awarded. It is a fact that rod has been fitted. It has to be removed. He has to undergo further treatment. So, for future medical expenses Rs.5,000/- is awarded. 9. In the result, the appeal is allowed in part.

The compensation awarded by the Tribunal is enhanced to Rs.1,49,500/-(Rupees One Lakh Forty Nine Thousand and Five Hundred only) with 7.5% interest per annum from the date of filing the claim petition till deposit and costs. 2nd respondent shall deposit the entire amount, less amount, if any already deposited within four weeks from the date of receipt of a copy of this Judgment. On such deposit, the appellant is permitted to withdraw the entire amount, less amount, if any already withdrawn. No costs.
