ORDER 1. This is an application under section 438 of the Code of Criminal Procedure for grant of anticipatory bail to petitioner for offence under section 306 of IPC, in connection with Crime No. 133/2013 of Police Station, Simariya, District Panna (M.P.). 2. According to prosecution on 31.3.2013, on Gandharva Singh committed suicide by drowning feeling frustrated with the illegal relations of petitioner with his wife. Prior to committing suicide, Gandharva Singh killed his wife also and then ended his own life. 3. Learned counsel for the petitioner submits that this story of illegal relation has been brough on record by parents of the deceased after more than period of three months. Possibility of frustration and pressure on the mind of the deceased also cannot be ruled out because he had killed his innocent wife. Learned counsel further submits that petitioner is apprehending arrest for the incident which took place more than 5 months ago for which he has no direct connection neither with the deceased nor with the wife of the deceased. 4. Per contra, learned Panel Lawyer submits that allegations are serious and there is sufficient evidence against the petitioner. 5. On due consideration of the facts and circumstances of the case, I deem it proper to grant anticipatory bail to the petitioner. Petitioner Guttiraja alias Pratap Singh Thakur is directed to join the investigation/trial immediately and to fully cooperate with the investigating agency and the trial Court as the case may be. In the event of arrest, petitioner shall be released on bail on his furnishing a personal bond in a sum of Rs. 30,000/- with a surety in the like amount to the satisfaction of arresting officer/trial Court. 6. Conditions of section 438(2) CrPC shall apply on the petitioner during currency of bail.
