Hon'ble MEHTA, J.—The bail application was allowed by this Court by order dated 3.1.2013 but the matter was kept open for receiving a report of the DGP for ensuring that the witnesses of the Police Department are examined at the trial without any delay. 2. Today Shri Pradhuman Singh has filed the report/guidelines issued by the DGP for ensuring early examiation of the Police Witnesses before the trial vide circular dated 8.1.2013. 2. The guidelines are in consonance with the provisions of Section 309 Cr.P.C. and thus, have to be carried out in their letter and spirit. 4. Since the circular makes an expectation of active participation of the Court concerned particularly in para-5 thereof it has to be directed to all the courts that the requirement of para no. 5 regarding mentioning of the F.I.R. number, the offence for which the case is registered and the marking of warrants in red colour shall be necessarily and mandatorily carried out by the concerned trial Courts so that the delay in recording of the evidence of witnesses can be effectively avoided. 5. For the purpose of apprising the courts with the said circular and guidelines, it is hereby directed that the copy of the circular No.CID/CB/PRC/ Paripatra/(35)/2012-13/257-325 dated 8.1.2013 be forwarded to all the Sessions Judges in the State of Rajasthan for onward communication and compliance. 6. The petition shall not be listed in the Court any further.
