JUDGMENT Mr. Mehinder Singh Sullar, J. (Oral):- Petitioner-Gurdial Singh son of Fauja Singh, has preferred the instant petition for the grant of regular bail in a case registered against him along with his son and main accused Surjit Singh @ Jitta, vide FIR No.18 dated 10.03.2013, on accusation of having committed the offences punishable under Sections 363 and 366 read with Section 120-B IPC (the offence punishable under Section 376 IPC was later on added), by the police of Police Station Fattu Dhinga, Kapurthala, invoking the provisions of Section 439 Cr.P.C. 2. Notice of the petition was issued to the State. 3. After hearing the learned counsel for the parties, going through the record with their valuable help and after deep consideration of the entire matter, to my mind, the present petition for regular bail deserves to be accepted in this context. 4. The prosecution claimed that on 05.03.2013, the prosecutrix Ruppreet Kaur @ Rubbi, was missing from her bed. Her adopted father Dalbir Singh has reported the matter to the police, wherein, he has suspected that the prosecutrix may have been allured by main accused Surjit Singh @ Jitta (son of the petitioner). Subsequently, it was alleged that Surjit Singh @ Jitta has committed the indicated offences with the connivance of his father Gurdial Singh. How, when and in what manner, the petitioner connived with his son remained unfolded mystery. Otherwise also, it is highly improbable to believe that father would help his son to indulge in such illegal activities. The main allegations of kidnapping and rape, are assigned to Surjit Singh @ Jitta (son and coaccused of the petitioner). 5. Moreover, the petitioner was arrested on 10.03.2013. Since then he is in judicial custody and no useful purpose would be served in further detaining him in jail. The conclusion of trial will naturally take a long time. 6. In the light of aforesaid reasons, taking into consideration the totality of facts and circumstances, emanating from the record, as discussed here-in-above and without commenting further anything on merits, lest it may prejudice the case of either side during the course of trial of main case, the instant petition for regular bail is hereby accepted. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of the trial Court.
