ORDER Mohan M. Shantanagoudar, J. Petitioner is stated to be an Environmentalist. According to him, he has been working hard for saving the environment in the State in general, Kolar and Chikkaballapur Districts in particular; that he has been fighting relentlessly against the smugglers of minor minerals etc. and has saved more than Rs. 50 lakhs to the State by spending his finances. The State Governmental authorities have been recommending to the State Government for honouring the petitioner with the Awards like Rajyotsava Award since no award is conferred on the petitioner in spite of repeated requests of public and Governmental authorities since six years, this writ petition is filed for the following relief: "b) to issue writ of mandamus directing the respondent Nos. 4 and 5 to consider the recommendations, directions at Annexures-A to F3 made by the Government and to pass appropriate order to commemorate the petitioner with suitable State Award and support for livelihood for the good social cause relentlessly fought by the petitioner". 2. This Court will not normally interfere with in the process of giving State Awards, etc. If any of the personalities, including the petitioner are entitled for getting any Award such as Rajyotsava Award, etc., the State Government would definitely consider the request of such persons. There cannot be any compulsion on the State Government to honour any person with Award. It is for the State Government to choose a particular person for a particular Award. It is for the State Government to give the Award to the personality, if he deserves to be honoured. There may be number of personalities in the State who deserve for the Awards, but Awards cannot be given to every such person because of financial and other constraints. It is expected that the State Government should not get influenced by any of the recommendations from any Quarters. The State Government needs to confer the Awards on the personalities who have excelled in particular fields. The conferment of honour shall be in the public interest and on the basis of the service rendered by such persons for the public at large. It is not expected of any of the personalities to file application seeking Award. The act of inviting applications and the interference by third parties in the matter of honouring personalities constitutes disrespect. The undeserving people shall be excluded from consideration in the interest of Nation at large. 3. Sri Shivaprakash, learned Advocate for the petitioner argues that the State Government may at least be directed to consider the request of the petitioner to give an Award in the light of certain recommendations made by the Committees. I decline to issue such a direction also. It is for the State Government to consider and honour appropriate and deserving person with Award. Awards should not be asked or prayed for, but the same should be conferred. Honour cannot be sought or demanded, but the honour should be earned. The situation to seek the Award should not have been arisen. The State Government shall take independent decision in the matter for honouring the persons who actually deserve the honour. Hence I decline to interfere with such matters by directing the State Government to consider the request of any particular person. It is deemed that the State Government will take independent decision based on merits, independent of any of the recommendations. Hence, writ petition fails and accordingly, the same stands dismissed.
