ORDER 1. Being aggrieved by the order dated 13.9.2013 passed by MACT, Indore in claim case No. 06/09, whereby the learned Tribunal has directed 20% of the amount paid to the petitioner, present petition has been filed. 2. Learned counsel for the petitioner submits that in a claim case against the award passed by the learned Tribunal for a sum of Rs. 1,31,854/- an appeal was filed by the petitioner which was numbered as 2149/10 and was allowed vide order dated 9.11.2012 whereby the amount was enhanced by Rs. 1,18,146/-. It is submitted that the amount was payable upon depositing the court fee and petitioner deposited the court fee of Rs. 11,815/-. It is submitted that after depositing the amount by Insurance Company, the learned Tribunal has directed 20% of the amount deposited including the court-fee deposited by the petitioner. 3. From perusal of the record it is evident that directions of this Court was that 80% of the amount which was enhanced by this Court be deposited in fixed deposit and not 80% of the amount including the court fee. In view of this, petition is disposed of with a short direction that learned Tribunal shall deposit 80% of the enhanced amount only and the balance amount shall be released to the petitioner. 4. With the aforesaid, petition stands disposed of.
