ORDER : H.S. Kempanna, J. 1. The petitioner, who is arrayed as A2 in Crime No. 165/2013 on the file of the respondent/police registered for the offences u/Ss. 406 and 420 r/w. 34 of IPC, is before this Court seeking for grant of Anticipatory Bail. The respondent/police on the complaint of one Latha W/o. Dhananjaya, Alanahalli, Mysore City have registered the above case against, the petitioner and another by name Ravindranath and have taken up investigation. 2. It is alleged that this petitioner and others had collected deposits by installments with an assurance that they would pay attractive interest and incentives. Since the petitioner and others failed to keep up their promise, the complainant filed the complaint on the basis of which the above case is registered and investigation is taken up. 3. Learned counsel for the petitioner submits complains of similar nature have been filed by different persons who are similarly placed as that of the complainant in the districts of Kodagu Madikeri, Kolar and Mysore Districts. Cases have been registered for the similar offences by the said police against this petitioner and another. He further submits that the trial Court has enlarged A1 - Sri. B.L. Ravindranath on bail in this Crime number and in respect of other cases, which have been registered by different police in the aforementioned three districts, he has been granted bail by this Court in Criminal Petition No. 4681/2013 and other connected matters. He further submits the allegations attributed to this petitioner is that she had received the money by way of installments from the respective complainants and had deposited to the account of the Company viz. Green Buds Agro Farms Ltd. run by A1. As A1 has already been released on bail by the Trial Court and this Court having regard to the allegations attributed to this petitioner and as she is a lady, she be granted the relief of Anticipatory Bail. 4. The allegations in the complaint reveal that this petitioner was working as an Accounts 'Assistant in Green Buds Agro Farms Ltd., a firm ran by A1. She was receiving the installments paid by the complainants and depositing the same to the Company's account.

Since A1 has already been granted bail by the Trial Court and also by this court in other cases which has been registered against this petitioner and A1, in the circumstances, I do not find any justification to decline the request of this petitioner also. Accordingly, I proceed to pass the following:-- ORDER i) The Petition is allowed; ii) The petitioner in the event of her arrest in Crime No. 165/2013 of Nazarbad police station, the said police are directed to release her on bail on her executing a personal bond in a sum of Rs. 50,000/- with one surety for the like sum to the satisfaction of the said police subject to the following conditions:-- 1) She shall appear before the respondent/police for the purposes of her arrest and release on or before 30.12.2013; 2) She shall not tamper with the prosecution witnesses; 3) She shall make himself available to the Investigating Agency as and when required for the purposes of investigation.
