ORDER : H.S. Kempanna, J. 1. The petitioner who is arrayed as A. 2 in Crime No. 70/2009 of the respondent police registered for the offences under Sections 11, 13(1)(A), 14, 15, 38-A, 43-A, 32(1) of Karnataka Excise Act, is before this Court seeking for grant of anticipatory bail. It is alleged among other things in the complaint that on 14.6.2010 at about 6.00 p.m. this petitioner along with A. 1 had indulged in illegally transporting illicit liquor on the motorcycle bearing Reg. No. KA-13-H-8067. 2. Learned counsel for the petitioner submits that A. 1 in this very crime has already been granted anticipatory bail by the Jurisdictional Sessions Judge on 25.8.2013. Having regard to the offences alleged, as A. 1 has been granted anticipatory bail, this petitioner also be granted the same relief as sought for by him. 3. The application filed by the petitioner is opposed by the learned High Court Government Pleader. Having regard to the offences alleged and taking into account that A. 1 has already been granted anticipatory bail by the Jurisdictional Sessions Judge on 25.8.2010, in the circumstances, I do not find any justification to decline the request of this petitioner. Accordingly, I proceed to pass the following: ORDER Petition is allowed. The petitioner in the event of his arrest in Crime No. 70/2009 on the file of the respondent - police, they are directed to release him on bail on his executing a personal bond in a sum of Rs. 20,000/- with one surety for the likesum to their satisfaction, subject to the following conditions:-- 1. He shall appear before the respondent on or before 15.12.2013 for the purpose of his arrest and release. 2. He shall not tamper with the prosecution witnesses. 3. He shall appear before the police as and when required by them and before the Court on all the dates of hearing.
