Judgment Naresh Kumar Sanghi, J. Prayer in this petition is for grant of anticipatory bail to the petitioner, Maheepal Singh, who has been booked for having committed the offences punishable under Sections 7 and 12 of the Essential Commodities Act, 1955, in a case arising out of FIR No.84, dated 25.06.2013, registered at Police Station, Nangal, District Ropar. Learned counsel contends that concededly the petitioner is the responsible person/Analyst of the manufacturing company of the fertilizer, but the fertilizer from which the alleged sample was drawn was manufactured in the year 2010 and thereafter, the alleged sample was drawn and the same was analysed 02 years and approximately 06 months thereafter. According to analyst, the sample was not found according to the standard laid down in the Fertilizer Act. He further submits that the petitioner has joined the investigation and co-operated with the Investigating Agency. Learned counsel for the State though opposed the grant of anticipatory bail to the petitioner but conceded, on instructions from ASI Sohan Dubedi, Police Station, Nangal, District Ropar, that the petitioner has joined the investigation and no more required by the Investigating Agency. In view of the totality of the facts and circumstances of the case, the present petition is allowed and the interim directions dated 01.10.2013 passed by this Court are made absolute. The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2), Cr.P.C.
