JUDGMENT : Rajendra Menon, J. 1. This petition is pending since 2011 and even though various opportunities have been granted respondents have not filed any reply. On the last date it was specifically directed that if reply is not filed, matter shall be heard and decided. Inspite thereof return has not been filed and therefore, the matter is being decided based on the material available on record. Petitioner is working as a Sub Engineer and was deputed to work in Janpad Panchayat, Satna under the department of Rural Engineering Service. Petitioner is said to have worked in the department since January 2008. However, when certain traveling allowances and salary to the petitioner for the period April 2010 to October 2010 was not paid, records indicate that petitioner represented and when the representations were not considered, this writ petition was filed. 2. By this writ petition petitioner claims settlement of his Travelling allowances for the period from February 2008 and salary for the period from April 2010 to October 2010. Available on record are various documents namely Annexure P/10 to P/14 which are communications made by the petitioner and the Superintend Engineer of the Rural Engineering Department, Rewa to the Collector and the District Chief Executive Officer of the Janpad Panchayat indicating that the claim of the petitioner for payment of travelling allowances and the salary for the period in question has not been settled and a request has been made for settlement of the claim. It seems that inspite of various communications made, nothing has been done and it is said that till date his claim has not been settled. 3. Even though respondents were granted various opportunities during the last two years to file the reply they have not filed any reply. 4. Keeping in view the aforesaid, for the present it is directed that on the petitioner's filing certified copy of this order along with relevant documents, respondent No. 5 the Collector concerned shall cause an enquiry into the matter of payment of traveling allowances and salary to the petitioner for the period in question and after hearing the Chief Executive Officer respondent No. 2 shall decide the question in accordance to law within a period of two months.
It is directed that if on such enquiry it is found that any amount is due to be paid to the petitioner, the same shall be paid to him within a period of two months along with interest at the rate of 9% per annum. The Interest shall be calculated with effect from the date the amount became due till payment is effected. It is further clarified that if on enquiry the Collector for any reason whatsoever comes to the conclusion that the amount is not due and payable to the petitioner, it shall be incumbent upon the Collector to record the reason for the same and communicate it to the petitioner. Needless to emphasize that while conducting an enquiry, an opportunity of hearing shall be granted to the petitioner and a decision taken after hearing the petitioner. 5. With the aforesaid, this petition stands disposed of.
