Judgment Sabina, J. 1. Petitioners have filed this petition under Section 482 of the Code of Criminal Procedure, 973 seeking quashing of complaint No. 154 dated 21.8.2010 under Section 138 of the Negotiable Instruments Act, 1881 ('the Act' for short) (Annexure P1) along with all consequential proceedings arising therefrom. Heard. 2. During the pendency of the petition, parties have amicably settled their dispute. In fact, the dispute between the parties is with regard to the tenancy. Admittedly, petitioners have deposited Rs. 63,00,000/- before the Rent Controller in terms of the order passed by the said Court. 3. The case of the petitioners was that the cheque in question was liable to be returned to the petitioners. Despite the said fact, petitioners had agreed to pay the cheque amount in question to the respondent before the trial Court but they had refused to accept the same. However, during the pendency of the petition, respondent agreed to accept the cheque amount in question. 4. Krishan Kumar has appeared in person on behalf of the complainant-respondent-Anita Rani. Rs. 1,30,000/- were paid to Krishan Kumar, husband of respondent-Anita Rani on 24.7.2012. Today Rs. 63,500/- in cash have been paid by the counsel for the petitioners to Krishan Kumar, husband of respondent-Anita Rani. Krishan Kumar is also attorney holder of the complainant-respondent-Anita Rani. 5. Since the cheque amount in question has been paid by the petitioners to respondent, learned counsel for the respondent, on instructions from Krishan Kumar, has submitted that he has no objection if the complaint in question is ordered to be quashed. 6. As per Section 147 of the Act, every offence under the Act is compoundable. Accordingly, this petition is allowed. Criminal complaint No. 154 dated 21.8.2010 (Annexure P1) under Section 138 of the Act and all consequential proceedings arising therefrom including are quashed. Petition allowed.
