JUDGMENT Mr. Naresh Kumar Sanghi, J.:- Prayer in this petition is for grant of regular bail to petitioner Rajinder Kumar Garg who has been booked for having committed the offences punishable under Sections 420, 465, 467, 468, 471 and 120-B, IPC, in a case arising out of FIR No.229, dated 07.09.2013, registered at Police Station, Mandi Gobindgarh, District Fatehgarh Sahib. 2. Learned counsel contends that even if the case of the prosecution is taken at its face value then also the mischiefs of sections for which the petitioner has been booked are not attracted; that all the offences for which the petitioner has been booked are triable by the learned Judicial Magistrate Ist Class; and that the petitioner is behind the bars from 09.09.2013. 3. Learned counsel for the State, on instructions from ASI Kuldeep Singh, Police Station, Mandi Gobindgarh, District Fatehgarh Sahib, very fairly concedes that there are no allegation of cheating and forgery so far as the petitioner is concerned. He further submits that the only allegation against the petitioner is that after registration of the case, he wrongly informed the police with regard to missing of his sons so that the complainant could be implicated in a false case. He, however, submits that the material has emerged on record that the petitioner forged the signatures on the cheques allegedly issued by the complainant. 4. On a specific query by this Court, learned counsel for the State very fairly concedes that the report from the handwriting expert has not yet been received and as such, it cannot be affirmatively said that the said cheques were forged by the petitioner. 5. Learned counsel for the complainant opposed the grant of bail on the premise that the petitioner in connivance with his sons committed the offences, therefore, he does not deserve the concession of bail. 6. I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. 7. The forgery as alleged by the prosecution would be a moot point during the course of further investigation or trial. The main allegations are against the sons of the petitioner. All the offences for which the petitioner has been booked are triable by the learned Judicial Magistrate Ist Class. The petitioner is behind the bars from 09.09.2013. His both sons are also behind the bars.

Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Rajinder Kumar Garg, s/o Achru Ram, r/o H.No.20, New Asha Puri, Ludhiana, is ordered to be released on bail during the pendency of the investigation/trial of the present case subject to his furnishing bail bond in the sum of Rs. 2,00,000/- with two sureties in the like amount to the satisfaction of the learned Area Judicial Magistrate/Duty Magistrate, Amloh, District Fatehgarh Sahib. The heavy surety has been ordered to be furnished keeping in view the magnitude of the offences alleged to have been committed. ---------0.B.S.0------------
